We found out some years ago when my hubby (boyfriend at the time) came to visit that due to an error on papers when he left, he needed an ARC to return. We applied and waited 2 and a half years only to have it denied. We have been very happily married now 2 years and I can't get to bring my hubby home to Canada. What can we do. We are devastated.

Why did he need the ARC and what reason have you received for the ARC being denied?

Did you apply for the ARC as part of a spousal sponsorship application?

Have you ordered your GCMS notes yet? (If not, do that as soon as possible.)
 
Thank you. His refugee claim was denied initially and during the process of attempting to appeal paper work was sent to him at the wrong address that he did not receive. They sent it to an old mailing address even though they had the right address on file. He decided to leave Canada on his own. He didn't realize there was a problem until years later when he came for a visit.

Did you apply for the ARC as part of a spousal sponsorship application? Or did you apply for the ARC separately?

We applied for it separately. This was done before we got married. The plan was to do this first. So he can at least visit. Once we got married then we would have done the sponsorship.

An ARC is typically only granted for compelling reasons to return to Canada, like care of family, medical treatment, etc. "At least visit" isn't a compelling reason to return to Canada.

You should apply for sponsorship. They will request another ARC during the process.

That's probably part of the problem. With a failed refugee claim and overstay, coming as a tourist here really wasn't ever going to be possible for him again. Applying for spousal sponsorship along with the ARC would have been the better way to go.

He is Visa exempt. In Barbados.

You need to apply to sponsor him as your spouse for PR and include the ARC as part of that application.

He's not going to be allowed to come back here as a tourist given his history in Canada.

He will be able to return once the PR application is approved.
