How does CIC verify the skill type or level of your work experience?

Hi

This may effect anyone looking to Immigrate via the CEC route, as everyone must have 1 or 2 years "skilled" work experience to meet the minimum requirements. If you've already read all the relevant website material skip to the bottom of this message, otherwise read on.

CIC states foreign graduates only need 1 years "skilled" work experience, while everyone else needs 2 years. As stated here:

cic.gc.ca/english/immigrate/cec/workers.asp

Within that page CIC explains that "skilled" work experience means, with respect to NOC classification, Skill Type O, Skill Level A, or Skill Level B.

following the link "Requirement for temporary workers" at the bottom of the page to:

cic.gc.ca/english/immigrate/cec/workers.asp

noting the use of the word "probably" the following text is written:

"If the description and list of main duties for a job classified under 0, A or B match what you did while you worked in Canada, you probably meet the requirement for that type of experience."

the following text is also written:
"You do not meet the minimum work experience requirement if:
... you gained your work experience without the proper status (for example, as an undocumented worker)"

These are my questions:

1. What is meant by "proper status"?
2. What is an undocumented worker?
3. How does CIC verify the skill type or level of your work experience?

If anyone knows the answers please answer.

Alex, I recall your recent and older posts... Sorry about the following, just my semi-learned opinion...

1. What is meant by "proper status"?

This means proper residence/work permits. A TWP is issued for a specific position, which will be identified on the TWP and LMO along with the NOC code. To change to a different position, even with the same employer, you are supposed to get a new LMO/TWP. If you change without a new LMO/TWP, well then, you might be considered unauthorized. If you are doing a higher level job while authorized for a lower level, then your employer might be in for a world of trouble for "exploiting" you, or for simply not obtaining the proper authorizations.

2. What is an undocumented worker?

Would be called an "illegal alien" in the US. Means you are living/working without approval, without proper documents.

3. How does CIC verify the skill type or level of your work experience?

a. Your TWP, LMO
b. Your contract with your employer
c. Your employer's letter of reference - description of duties & responsibilities

If there are discrepancies between a, b, c - these could be red flags.
