Hello!

Thank you for reading my post. :D

I am a Canadian but my parents are from China. I would like to apply for sponsorship for my parents. HOWEVER, my parents hold the EXPIRED PR card.

I would like to ask three questions.

First question, are my parents eligible to apply for parents sponsorship?

Second question, should they give up immigration status which they still have it(immigration paper) for now?

Third question, if they give up the immigration status and apply for the 10-year-VISA from China, can they still apply for parents sponsorship in the future?

My parents are in a dilemma of whether giving up the immigration status and apply for VISA in the future or wait many years until they have the parents sponsorship(if eligible).

My parents and I really want to come to Canada and live with me in the future so that I can take care of them when they get old. However, they have to take care of my grandmother since she got cancer now. That is the reason they cannot come to Canada now.

Please help me with these question. I really miss my parents. Thank you so much for your reply!

No, as they are already PRs. Just having your card expire, doesn't mean your PR status is gone.

It's up to them. If they don't meet the residency obligation, then there's a good chance next time they try to apply for a PR Travel Document or come to Canada they'll be reported and have their PR status taken away or would need to appeal the decision if they have H&C grounds.

If they renounce their PR status, then you could possibly apply to sponsor them again for PR in January 2017 if you have necessary Canadian income for your family size, in 2013, 2014 and 2015. If you got app accepted into the 10,000 cap, it's probably then a good 5 year wait until they get PR.

Third question, if they give up the immigration status and apply for the 10-year-VISA from China, can they still apply for parents sponsorship in the future?

Yes, the visitor visa and PR apps are unrelated.
