Hi, i have a few questions, but i think to better help you i should explain my situation..
I'm American and arrived in Canada on May 28th 2014 (2nd time here) I got a stamp with the date i entered with no writing on the bottom.
So, i took that as having 6 months to stay, i married my Fiance in September 2014.
My 6 months should have been up Nov. 28th 2014, but i stayed because my husband and i were trying to work out Sponsorship applications.
I know that i am allowed 90 days after my 6 months (Feb. 28th, 2015 is 90 days) but we bought tickets to move back to the US in March.

My questions are,
1. How do the visiting rules change after marriage? (IF THEY DO)
2. Do i have to apply for an extension even if i already know i'm leaving a little over a week after my 90 days?
3. Are there any penalties with the US customs since those are the guys i pass through leaving?


I have been going out of my head with worry!! :o

You entered in canada on May 28th 2014 and you were only allowed to live in Canada till 28 Nov 2014. After 28th Nov you are out of status and you are overstaying which can badly effect your future visits to canada and your pr application. the best was to apply for an extension before 28 nov to remain in a legal status. Now you are out of status and you can only apply for restoration of status NOT extension to stay. if you now leave canada without having a legal status (i.e visitor status) you may not be allowed to enter in canada as you had violated the immigration rules (by overstaying) it can also result a ban (2 years) to enter into canada. Most likely you may also receive a deportation order soon if you do not restore your status as soon as possible. after 90 days you will also loose this option to restore your status.
so your first course of action should be to restore your status as soon as possible as you are illegal in canada right now.

Spouses who are in canada as a visitor and had or are in process to submit a sponsorship application (inland or outland) can live in canada through out the PR application process but they must maintain a legal status (i.e visitor status) during all the time. todo this they apply for extension to stay in canada before their allowed time is due to expire. Once your status expires you can not apply for an extension.

Short answers to your questions:
1. How do the visiting rules change after marriage? (IF THEY DO)
visiting rules remain the same each time you seek entry into canada you must be a genuine visitor. if you have violated any immigration rues they wont let you enter.

2. Do i have to apply for an extension even if i already know i'm leaving a little over a week after my 90 days?
You are already out of status so you cannot apply for an extension. after 90 days you wont even have an option to restore your status. and if you leave canada with an overstay immigration record you will face serious problems in entering canada and with your sponsorship application.

3. Are there any penalties with the US customs since those are the guys i pass through leaving?
if you are a us citizen you wont face any problem entering your country.
