I said "part" of one year of experience. So my work permit expired on september 27 2012, And till then i had 9 months of experience and I applied for a work permit on spousal basis and I am expecting to receive a reply next week so its been almost 6 months since i have been on implied status. And I wanted to know If this can be counted as my work experience.

Thanks

Yes, the experience when you are under implied status is counted. You must however provide documentation with the application that you had legal temporary status in Canada during the period of qualifying work exp.

You will likely need to prove to the VO officer that you were on implied status and that your "self employment" period was actually a period of employment.

I'm really confused as to what you are expecting... Are you looking for everyone to say your period of self employment and periods on implied status will be okay? If so, it's pointless. Your situation is far from simple and actually, as everyone has said, may not be successful.

T4 = employment. T4a = self employed contractor.

If you are going to succeed, you will need to provide an explanation letter and evidence to prove that 1) you were "employed" during this period and 2) you were actually on implied status... Otherwise, you have a high chance of rejection.

Good luck.

Hi

So I have 9 months of experience with T4 till July and then from august till December I was on contract but was given a full time position from January.

So I will have my paystubs from January till March . I think that qualifies me completely for one year even if T4a is a problem.

What do you say?

I say there is another threat open about the exact same thing... About 2/3 threats down from the top of the forum!

T4a = self employed. Self employment is not eligible for CEC.

But since I have 1 year of full time experience then why is a T4a a threat anymore??

Are you saying you had 9 months of employment with a T4? Then another 5 months of employment with a T4?

It's not clear - you said you were on contract, you then mention a T4A...

okay I had 9 months with T4 then 4 months with T4A and 3 months paystubs i.e full employment.

:)

So as long as: -

You have 12 months of 30+ hours per week in skilled work where you were employed (T4) you should be fine.

You need at least 1 year of skilled full-time(30hrs/week) employment. Only the periods for which you were an employee (i.e. your employer deducted CPP, income tax, etc and for which you have a T4 will count towards CEC).

So you mean the three months jan 2013 - march 2013 where my employer deducted all the taxes and everything dont count??

Because obviously I cant have the T4 for this year?

And does that mean If I had experience from Jan - Dec I couldnot apply for PR before I had filed my taxes??

Doesnt sound very right to me :D

If your employer deducted taxes, CPP, etc that would make you an employee and you should receive a T4 next year in February. Your employment letter needs to clearly distinguish the periods you were an employee from those you were self-employed, otherwise it could confuse the visa officer.

Yes, see answer above.

You were self-employed(paying your own taxes) from Aug - Dec, so you can't count that anyway for CEC.

Doesnt sound very right to me :D

Obviously :) Yes, you CAN count your experience in 2013. Since you wouldn't have a T4 for that employer, tho, this is one situation where it would be a good idea to submit paystubs. I would submit a copy of only the most recent pay statement if it has cumulative information (Year-to-date) on it.

Yea I have all the biweekly paystubs from Jan till march . so think should be good :)
