Hello, I hope anyone can help me with some advice as I think I have to leave the country and my life in canada is ruined.

On June 2014, my lawyer applied for a nomination for me from the province of Alberta (engineering stream). My work permit was expiring on December 2014 and I was getting afraid that my nomination will just not come in time, so on September 2014 I went ahead and applied for a permanent residency myself, using Canadian Experience Class (CEC) application.

Two days before my work permit expired, I actually received a nomination, so I used it to apply to extend my work permit. On January (today) I received a letter that my work permit extension has been refused. And that I have 90 days to restore my status.

Right now I am without a job in calgary.i have no work permit and cannot restore it because I have no job offers. I can't even get a job offer that will wait for 4 months in order for me to restore my status and get my new work permit.

I thought about leaving the country and waiting for my CEC application to get approved, and then while outside canada I will get my PR and come back.

Another option is to restore my status as a visitor. I don't think I can do this because I will not have enough money to stay here as a visitor, because I need to work..

Another option is to get accepted to a university here and get a study permit, but I can't do that too because internatiom tuition costs are expensive.

Another option would be to get an LMIA. But still, I don't think an employer will wait for me to restore my status. That takes 4 months...

Also, should I let my CEC application go to approval (I have not received an AOR yet), or should I reapply for PR using the PNP way?

I don't know what to do. My goal is to stay and work in canada.

Please help!!

Hi,

Why did CIC refuse to extend your work permit? If you could copy/paste the contents of the refusal letter it will help us understand the reasons behind the refusal and offer some advice.

Wasn't eligible.

AINP nomination alone is not enough to be eligible for a work permit. Didn't have written job offer, is my guess.

To be eligible for the BOWP, the OP would have had to have received the AOR for either the CEC or the PNP program. S/he hasn't yet received the AOR for CEC, and has not yet applied for the PNP. Because the work permit has expired, is no longer eligible for the BOWP.

Not 100% sure but I think if you get a written job offer, the AINP nomination can be used in place of the LMIA, and the OP can apply for a closed work permit and restoration.
