Hello everyone,
I would like to sponsor my husband to immigrate to Canada. I am a Canadian citizen and currently living in Hong Kong with my husband and baby. Our baby was born in HK and he already obtained the Canadian Citizenship card.

I have several questions which I would like to clarify for the application. Sorry it's a little bit long!

Questions:

1) What is the definition of dependent children? Should my son be considered a dependent child although he already has the citizenship card? Eg. On the Application to Sponsor and Undertaking > Section C: Person being sponsored and his or her family members, question 3: Accompanying dependent children of persons in 1 and/or 2, do I need to put down our son in this section? Is he my husband's dependent child?


2) In the Sponsorship Guide > Who Can Sponsor, it mentions the following:
- you have an income that is at least equal to the minimum necessary income, the amount of which is published yearly by the Canadian government.
You will have to provide us with documents that show your financial resources for the past 12 months and prove you are financially able to sponsor members of the family class. You may solicit the help of a co-signer (must be your spouse or common-law partner). If you reside in Quebec, see also Sponsors living in Quebec.
This condition does not apply if you are sponsoring only
·your spouse, common-law or conjugal partner who has no dependent children, or
·your spouse, common-law or conjugal partner whose dependent children have no children of their own, or
·your dependent child who has no children of his or her own.


Do I have to comply with this requirement (to meet the minumum necessary income & provide financial proof for the past 12 mths) in my case? I am only sponsoring my spouse but I am not sure if my son is considered his dependent child?


3) In the Document Checklist Item 17, the Sponsor is required to produce "an original Option C Printout" of the last Notice of Assessment for the most recent taxation year. As I have been living and working in HK for over 10yrs and have claimed to be non-resident status, I do not have any tax assessments from Canada. What should I do?


4) On both the forms: Spouse Partner Questionnaire and Sponsor Questionnaire, it saids: On a separate sheet of paper, provide any additional details of your current relationship that you believe would help to prove your relationship is genuine and continuing.

Can I use the same evidence (eg. emails, photos, letters, etc) to answer the question to both forms? Or do they have to be separated and use different evidence? Also, do the answers have to be different for the 2 forms since the details of our current relationship are the same.

1) Your son is not listed as a dependent child because is is already a citizen and is not being sponsored. He will only be listed on the additional family information form.

2) By all means give them information about your income since they ask for it but they will not deny you because of it because when sponsoring only a spouse, you are exempt from income requirements.

3) Include a letter stating that you do not have an option C because you have been in Hong Kong for 10 years.

4) Use the same answers and same evidence.

5) As you are living outside Canada, you also need to include evidence that you are planning on moving to Canada when your husband gets his PR. This could be something like a job offer, having been accepted to college, having arranged housing or at the very least letters of support from friends/family who know you are moving and have offered to help and let you stay with them while you look for housing.

Page1 - Question 6B - "Every other family member not included above and dependent on you...financially, whether....."
and
Page2 - Question 6B - "Every other family member financially dependent on you....and not listed in Section C of your Application to Sponsor and Undertaking.." ?

For 5), Thanks for your reminder on providing evidence of my intention to move back to Canada after my husband gets the PR.

That comes to another question (sorry for so many questions!), it asks for the Date I plan to resume residency. I will go back once my husband gets the PR... but I won't know what date that is! So I just make up any date that I think they will approve the PR??

Also, it asks "Where do you plan to live upon return", is it asking for the City (like Toronto)?? Or the address of my home (if I already bought/rented one) or address of my family/relatives where I plan to stay?
 
I do believe you should put down your son in the sponsorship evaluation as "every other family member dependent on you and not included in the application".

As for the date for your move, write that you plan on moving shortly after your husband gets his PR visa as you will need time to give notice for your job, give notice on your apartment and pack up. You can estimate how many months you need to wrap up, say 3 months after he gets his PR visa.

As for the city, write the truth. Do you plan to live in the city where your family is or do you plan to move there initially for a base location while you look for jobs elsewhere? Just tell the truth, then you don't have to remember later what you said.

You do allocate for your son there, yes. But it won't matter, because you are sponsoring your spouse, there is no financial requirement - even if you have a child as well.
