Hi,

I am currently on a work permit in Canada. At the end of July my work permit will expire and my employer does not want to go through the LMO process.

In July I would have completed my 24 months of work in Canada which means I would be eligible to apply under this class.

On the CIC website under the following guidelines the information is a little miss leading.

They mention the following:

All applicants must have:

temporary resident status during their qualifying period of work experience and any period of full-time study or training in Canada


Does this mean that I do have to have a work permit at the time of my application or do I have to have had a work permit during my 2 years of work in Canada in which case I did have.

they also mention the following:

You do not have to be in employed at the time of the application.

Since I will not have a work permit and no job it makes sense for me to return back to my country.

Am I still eligible for processing from my home country?

u dont have to be in employed at the time of ur application, that means that maintaining ur work permit is up to u but u must be in legal status during ur application process so either u get LMO,or u can apply for visitor's visa to remain legal in canada. u might go back home but let the officer know ur home country's address so that all ur correspondence will go there.

i beleived u need to apply from within Canada as ur work experience is in canada. wait for senior members to suggest as well
 
You may apply while in your home country, however, you should mail your application to the Centralised Intake Office(CIO) in Sydney, Nova Scotia and the visa office to process your application should be Pretoria. Since you still have over 2 months left on your work permit, why not continue applying for jobs? You may be able to find an employer willing to apply for LMO and extend your stay.

No, they can apply even while residing in their home country. The application should still be mailed to CIO in Sydney, Nova Scotia and the difference is in the visa office chosen to process the application.

I am just trying to play things safe.

If I am unable to secure another job and have to go home I want to be able to apply at Pretoria South Africa where I can do my medicals and they can request passports, would just be easier to operate from my home country.
