My partner and I received PR cards in Oct. 2010. We stayed in Canada 2 1/2 years before leaving for USA. Our cards expired
Oct. 2015 and as of the date we applied and application got to Canada Immigration we met the 760 day requirement for new PR cards. We applied from a Canadian address before our cards expired while we were still in USA.
We decided in early Dec. we wanted to go back to Canada and wait out getting new cards and thought we should get travel document so we would not be held up at border. But based on the application date in Dec 2015, we were now 10 days short of 760 requirement and our travel documents were denied.
We have three questions:
1)Does this decision supersede our application sent in August when we did meet the requirement? Will we still get an answer on that application (supposedly around March)?
2)If that application will still be evaluated, and it's been in Canadian Immigration hands for 4 plus months now, will they evaluate it from the date it was received (we would pass) or the date the finally look at it in a month or so(we would not).
3)Should we have applied for the renewal from the USA in the first place, not Canada? We would have met requirement. Should we now hire a lawyer and appeal and explain we met requirement back in August but simply applied from the wrong place?
