Hi,

Before I met my wife who lives in Nairobi, Kenya she had applied to immigrate to Australia but was denied an immigration visa after she did not pass her written test. She is fluent orally and written in english, but the tests are really tough for Australia immigration. She is still allowed a travel visa to go there. We met years after when she was visiting Canada on vacation, and now I am sponsoring her as my spouse. I recently submitted my application forms to the CIC Mississauga office, but now realise that on the schedule A background/declaration we answered no to the question:

"d) been refused refugee status, an immigrant or permanent resident visa (including a Certificat desélection du Québec (CSQ) or application to the Provincial Nominee Program) or visitor or temporary resident visa, to Canada or any other country"

I have two questions

1) did i answer this question correctly?
2) if no to question 1, how do I go about changing the answer? I mailed my application on Feb 6.

I want to avoid any chances of being declined due to misrepresentation. I want to be truthful.

Don't worry, as long as you correct it before review it's fine. You need to wait for a file # and see where the file has gone and send them updated first page of 5669 with explanation that you missed it
 
Thanks for the response. When I get the file #, can I just email them the first page? which email address should I send it to, if the file is still in Mississauga?

I suggest a proper form, don't rely on email with attachment. CIC-M will transfer file elsewhere so best to send to that office ( wherever that is )

On the other hand, its best to be honest but is it stamped anywhere saying "refused" for Auzzie visa? in her passport

Are you sure about this?!?!

I thought that once the original forms were received by CIC, (AOR), that changes or corrections could not be made, unless CIC asked for clarification on something.

If true, this could be helpful to someone that was rushed to get their application in, only to realize they had made an honest mistake.
 
My wife had applied as a skilled immigrant to Australia but was denied because she did not have enough work experience in marketing. Her passport was not stamped denied. This was back in 2001. She has visited Australia in 2008 with no problems getting a visitors visa.

Just wondering if we need to update that question to yes.

Someone will have a better answer than me but I recently had the experience of helping a friend who was getting a visitor visa to the US. She didn't declare a failed visa attempt and it was a big deal. Obviously this is a bit different but if I were you I would try whatever I could do to have it changed. Have you been emailed that they received your application? At that time they will give you a UCI (client) #.
 
Thanks. I called immigration today and they told me that once i get the reference #, they will contact me if they need more information. I want change the answer. So I will mail them an updated form as soon as I get the reference #. Its better to be honest upfront, then be denied for misrepresentation.
 
I still have doubts as to whether you can voluntarily change/update any of the forms once you have AOR. Isn't that considered your `locked-in' date with CIC?

Hopefully you are correct!

We had similar issue where I wrote basic details for my fathers work experience like 2000-2010 working, 2010 to current - Retired, then they asked us before 2000 but till that request came, I realized I need to provide visit status and work so I gave them before 2000 in all details and corrected the 2000-2010 in details as well ( the stuff they didn't ask details for but I corrected it ), I was in the same tension about misrepresentation but confirmed with PMM here and he said just give them all the correct info so we did and no issues

You know when PGP apps opened up, we had to send all forms at once IMM 0008 and Schedule A etc to CIC-M but those files which went to New Delhi were asked to submit the same forms all over again in bulk so considering you made a mistake in the original, you could technically correct them in the ones they ask for. In my case, they had incorrect email so I never got the request for all the forms again, instead when the due date came, the officer picked my file and saw the docs I sent to CIC-M and thus asked info above otherwise I had already corrected the work history part in details but due to wrong email fiasco, they asked me more info but regardless I provided everything correctly and it went OK
 
Thanks for all the advice and comfort. I will still send in updated forms just in case so that they can see there was an attempt to correct info. Hopefully it's a non-issue.

Giving CIC additional information IF THEY REQUEST IT is one thing. Changing something on a form that has already been submitted, without CIC asking about it first....is what I'm questioning.
