Application transferred to Nova Scotia

hello,

i have applied for skilled migration on may 9, 2008 and on march 10th, 2009 it was sent to NS- sydney.

the problem is, i am working in corporate sales department in a telecom company in bangladesh and when i applied on may 2008, i had no idea regarding the 38 NOC. Is there any chance of me getting a green signal from them?

please help if someone know anything regarding this issue?

take care...

I applied for FSW from CHC Islamabad in May 2008 with NOC 3216 (Meadical sonographer) and recieved an AOR the same month through my Consultant / Lawyer.

After the implimentation of the new Law, the NOC 3216 is no more on the ministerial list and todate I have not been able to get any AEO for that despite the help of BC Guy / Futuresearch canada.

My Consultant asked me for any updates in the situation and I have told them that I also have parallel experience of abt 9 years in the same time slot as 0311 (Medical Manages).

I am updating my info with my lawyer but my question is:

Q1: will my lawer be able to just update my application or He/She will withdraw and reapply for me?
Q2: will I get a new AOR no or will retain the old one?
Q3:will my application be then transfered to NS as it has not yet been done and I dont know about current status of my application?

As of now I am unable to access my CAS which I accessed in my past and even have copy of that but it now does not shows any Record on entering the same info.

will members help me understanding the situation and suggest what to do next.

I am again thankful for all who have helped me uptil this point.

Waiting for your replies.

1. You can't update the application to NS,it will be refused, so you will have to re-apply.

so do you think there is possibility of withdrawing my current application and entering a new one simultaneously?

If yes then wat would happen with the fees paid? will have to get the refund and give CIC a new payment?

I Will thank you again for your prompt and proper reply.

does the application moving to nova scotia means that its approved? if not why dont they just filter application with the noc not in the list this means that our application centers are doing nothing but only transfering application...! and everything is upto Sydney, Nova Scotia - C-50 office ?

Some people on the forum say it can take up to 6months for the refund of the application fee. I do think you can cancel your application to Sydney, but best you wait for them to reply and then cancel.

no, it does not mean its approved just because it goes to NS. I guess only NS can say for sure whether your duties fit those of the a NOC on the job list.

well where the whole world is trying to cut costs, they are making it more expensive for themselves by giving money to the hard working employees of NS as well as the staff of other countries i still don’t get it why don’t they just filter applications as they said that they wont evaluate the job description if the noc is not in the list...... so i don’t think the backlog will ever reduce
i think it would b rite to say here that common sense is not very common.... unless some1 answers this mystry

i guess they are trying to reduce the workload of the people at the visa office even if it means high cost. This may reduce the overall processing time at the visa office (i am guessing).

sonea,

Sorry, but I would have to disagree with you. Time is money. The Sydney Center always existed. This new process in which we have to send our application to Sydney first is because they do not want people to send application to their local office and have them returned for several reasons such as: people getting less than 67 points, NOC not on the 38 list and others. When an officer receives an application and has to return is because there is something wrong, it delays that person's application and the others'. Now, by having to send our application to Sydney and it is accepted, that means it should be quicker for the local office because they only have to check that the information we provided to Sydney is accurate and true. People are getting their AORs in less then 3 months now. How long did it take before?

I am happy and the new applicants should all be happy.

Cheers.

It is much cheaper to process the initial applications in Sydney, don't have to pay Foreign Service salaries, accommodation allowances and hardship bonus. Also with all the applications FSW1,2,3 going through Sydney, when CIC reaches its quota for the year they will know right away how many have been forwarded. So they will probably have a percentage that they feel will not qualify add that to the total forwarded to overseas office and once the quota is reached, the rest of the applications will be either returned and told to apply next year, or carried over to the following year.

That is a wrinkle in C-50 that no one talks about to limit the no. of applications and as well clear the backlog. So once the level of 68K to 72K is reached, that is it.
