Okay,

My fiance and i have applied to extend his stay as a visitor in Canada stating the reason as him wanting to spend more time with me.

The situation is this.....we are getting married and he legally has until the end of next month here. I called the immigration help line and they said that we should wait for a response from the government re: his visitor extension prior to sending spousal sponsorship paperwork....

My question is this. Once we get married, can we send a second visitor extension in to hopefully cancel out the first stating that we got married and paperwork is in processing?

What should we do? Im stressing like crazy :(

help! :(

THanks
in advance

-JL

Hopefully with your current application you'll get a year extension. Most of us did when we applied. We initially sent both the visitor's extension request and our spousal package at the same time. My husband's 6 months was up 4 days before we applied for the extension and everything went through nicely. I don't know why CIC is telling you to wait as the visitor's extension would have no bearing on your spousal application, it just means he has legal status and proof thereof with the document they send you.

Thanks for your reply,

Do you think with our current situation of being engaged they will grant him a year? I would be so thankful if they did (more time to process application for spousal sponsorship (once we get married and send it in).

I've been reading some negative things and my fear is that he will get denied and be sent home....

:( I don't know why he would but I Hear that the government doesn't care if you are engaged or not only if youre married...

I don't think you have anything to worry about. Visitor's extensions are given pretty freely.

I hope so I just dont want to be away from him :( love will do that to u!

Question #2: If he IS denied for whatever reason, do we have any recourse with that? Or will he have to leave married or not married?

You can apply for a restoration of status. It costs a bit more though. I think $150? Do a search on the forums here for visitor's extension. There's a wealth of information from people who have been through all case scenarios for the most part. I wouldn't worry though!

an extention would have a bearing on an in-land application if his visitor extension was denied he must leave Canada, then the PR would also be denied along with losing 1040 bucks....

sorry I didn't read this post in it's entirety yesterday... Since you have already applied for an extension if it is denied there is nothing you can do, you must leave no ands, ifs, or buts, restoration of status is only done when you have not applied for an extension before your visa expires.
