Hello,everyone, I am going to submit my documents very soon, but after reviewing all my documents, I found a very serious problem, My pgwp expired at 9,23,2012, and I renewed the WP at 10,5.2012. cause some friends told me this period belongs to the implied status,so during the proccessing time I kept working. today I asked one agent about it, and he said this period was restoration time, it was illegal to work. :(.since everything have already happened. tell the truth or hide?

any suggestions to figure this problem out? thank you very much

What date did you apply for the new wp and when did you get it?

Did you apply for your new work permit in October 2012 or did you receive it at that time? If you requested your new work permit before the old one expired (so prior to September 23 2012), you were indeed on implied status and then you are legally allowed to continue working under the same conditions.

If the above wasn't the case... yes, then you were illegal and NO you can't lie about that to the immigration office.

Yeah, I agree with you, I don't intend to lie about it to the CC, too bad, I applied for my new permit just after my first wp got expired, because my LMO had not come before the expiraition date. :(
 
If you had applied before expiration of PGWP than it would be fine, because in my case as well I had 8 days when I didn't have any work permit. You did unauthorized work for almost 5 months. As far as I know its illegal and your file will get rejected.
I would suggest you wait till Feb 20, 2014 to make everything look normal, Keeping in mind that you have already did illegal work in Canada.

Thank you for your suggestion, in your case, did the CIC ask you to explain why you had this unauthoried work expirence? thank you.

No, they never asked me because it was just 5 days difference. My SIN expired on 31st Aug but my last paycheck was processed on 28Aug & I got new issued on 6 Sep.. So by the time my next paycheck processed I had already renewed my SIN Card..
So technically I didn't have any paycheck processed on Expired SIN card..

good for your case, as you know CEC only require one year full time expeirence now, I started my work at Feb,6 2012, so even they deducted the whole 5 months unauthorized work experience, at the end of this July, my working time will still meet the requirement, I asked several lawyers about my case, some said it won't be a big issue, some said I need to hide the situation, now I am really confused, 5 months is not a short time, do you know any experienced lawyer? maybe some legal suggestion could be much helpful. thank you
 
I don't think hiding this fact is a good idea at all. They will find out about it anyway, as you have to answer certain questions in your application AND provide a timeline of all your activities over the last years.

Yeah. to be honest is very important in Canada, I'd better explain my situations by a form letter, the main mistake I made was that I confused the restoration and implied status, hoping they could be in a good mood, don't be mad with my case. ;)

Honesty is best but you need to be prepared that this could easily result in the refusal of your application. I'd suggest speaking with a good IO before going any further.

Thank you very much, I don't know where to find a experienced IO, I think I not the only person who comit this kind of fault, if anyone suffered the same problem. please tell me how you solve it, Thanks. all of you.

The issue is you can't solve it. You worked illegally - that's the problem. People have (recently) been rejected for this exact reason! It's not like forgetting to send a NOC or accidentally putting down the wrong NOC. You worked well beyond the expiry of your WP while you didn't have another application in process.

When you got your WP, it would have been made clear to you that you had to have stopped working / left by it's expiry. While I appreciate your circumstances (a little) you have to take responsibility for this.

Due to the seriousness (it's pretty serious) I'd suggest you focus on seeking legal advice instead of focusing on what can be offered here.
