On the form 5669, question FOUR Background/ Declaration says: Have you (principal applicant): been detained, incarcerated or put in jail?

I am Canadian and sponsoring my Mexican common law parter for his permanent residency. At age 20 (he is now 28), he was arrested for having 28 grams of Cannabis in his backpack. He spent four days in jail, went to court and the charges were dropped.

Does anyone in Mexico have experiences with police issues? Do you know if only criminal convictions show up on the "Constancia de Antecedentes Registrales" police report? We plan to disclose this information and write a letter to the Immigration Officer, but I'm wondering if he needs to apply for rehabilitation first with the Canadian Government?

If you have a similar situation, I would love to hear your experience.

Just based on what you've described above he was detained, and put in jail. Incarcerated may have a different meaning.

It's better to answer yes and explain what happened. If he wasn't convicted, he doesn't need rehabilitation.
