Good day husband file divorce in calgary I sent my statement of defense and counterclaim via mail through his address as indicated in his letter he refused to to accept my letter I also sent a copy of statement of claim to queens bench...can he really refuse to accept it?

Yes it does have something to do since husband wont include wife for pr app and applied for divorce so this is still in lieu of immigration concern

No, it has nothing to do with immigration. Regardless of the outcome of your legal battle, you cannot force the government or your estranged spouse to include you in the immigration app.

This is now solely a family law matter and this forum is not the appropriate place to post.

Agreed. This has absolutely nothing to do with immigration. It's a family law matter that needs to be posted to a family law forum.

Like the others have said, you should post your queries in a family law forum.

You cannot force your husband/CIC to include you in the PR application.

As this is a divorce action, hope you had served your statement of defense through a process server (listed in the Yellow Pages). You can also contact the Office of the Sheriff - Civil Enforcement in Edmonton.

If you are serving the legal papers from another country then the Sheriff's Office can help you to serve these legal papers, under the Hague Convention, through a bailiff.... as your husband had refused to accept it earlier.

You can't just mail them. The papers have to be served - handed to him directly. As you saw, he can always refuse a letter.
