We met 7 months ago and have been engaged for 6 months. I live in the winters in the Domoinican and am a born Canadian. She has a 4 year old son. So what is the best way to bring her to Canada to visit and apply for refugee status. Her family is from Port a Prince where they lost their houe to gangs and literally feared for thier lives. They escaped to the Dominican but live in daily fear of being deported back to the danger.

So a few questions. Has anyone been in this situation? Marying a Hatian and at the same time applying for refugee status?

Any help is appreciated. I do have friends in Canada some own businesses and may offer her a job.

You can apply to sponsor her once married. Don't need to claim refugee status. You need to prove that you live and work in Canada.

I am retired on a minimum pension of 2000 a month. GIS and OAS. Will that change? she will be a dependent until she finds work....and her 4 year old son.

You need to be financially responsibile for them so need to show you can support her and her son, who she has full custody of. Read the rules for spousal sponsorship with children. Show your Canadian residence, taxes paid etc.

Do you have other income/assets? Do you own a property/live with family that owns property.

Since her spouse is a Canadian, I do not think she can claim as a refugee. (She cannot even claim refugee outside)
Also since she has tie to Canada, it's uncertain if she will get visitor visa approved.

You and her got engaged 1 month after you two met? This is a very fast progressing relationship. You may want to gather more proof for the relationship if you eventually plan to apply to sponsor her.

There is no fix amount of income to sponsor spouse. But you need to make IRCC believe that she will not require social assistant (which you will need to pay back to IRCC if she ever applied for it within 3 years that she gets her PR.)

And what is her status in the Dominican? If she doesn't have legal status, it's going to be hard to get visitor visa to come to Canada.

So many red flags. Quick engagement, likely 20 year age difference or more, no status in country of residence, Haitian so major source country for refugees and most of the country is a mess, low income that couldn’t support a spouse and young child unless there are significant other assets, huge risk this marriage is purely immigration related and sponsor can not afford to pay back social assistance if fiancée leaves him, etc.

Best option would be to live together for at least a year before applying but if outside Quebec probably longer. Unfortunately OP can’t do that or they will lose healthcare and some benefits. Realistically need to spend multiple years winters together before there is any chance of success and OP should be covering the majority of the family’s living expenses throughout the year in DR (esp housing) but IRCC may still have huge concerns and this may not be possible financially. The other big issue is DR could deport her at any point.
