Is there anyone like me in this case?
Being in the U.S under H1B visa filed by your company and being sponsored by your spouse in Canada.
I ask because I was wondering if anyone can give advice on my case. i would like to move to Canada while I wait for my PR which went out just this week. But since I am on an H1B visa, once I move to canada which would mean quitting my job, I am no longer allowed to come back in the states. Can this pose a problem with them issuing me a visitors visa? Would this also pose a problem when they request for my passport and I cant go to the detroit office in person since I wont be allowed in the US again and then have to mail my passport in?

just exploring my options here cuz I would really like to be in Canada while I wait.

If you need an H1B for the US, do you first have a visa to get into Canada? You can visit for up to 6 months at the discretion of the border officer who will admit you, but if it looks like you're moving in before you have your PR visa, you can be refused entry to Canada.

Having had an H1B visa is no guarantee you'll be issued a B1/B2 or other type of visitor's visa, so if you don't get one, how do you propose to attend an interview if one is convoked? Mailing your passport to Detroit would not be an issue IF you don't hold a passport that cannot be mailed internationally. If you hold, for example, an Indian passport, it is illegal to mail it internationally, so you cannot send it to the US from Canada.

Perhaps it would be best for you to try to visit your spouse in Canada while remaining on your H1B visa until you have your PR visa and can fully move to Canada.

Yeah i think that is the decision my husband and I came up with. i have my canadian visa already but I would have to renew it soonest(expires this month) but the issue like u have said is what if I have an interview?? Too dicey to risk. There seems to be no way around it than to keep my job here in the US with my H1B visa and just be doing short visits till I am approved. Clearly quitting my job is not such a good idea as i had hoped :(

thanks again
