@annamanjk, congratulations on getting approval as a protected person.I GOT THIS BELLOW EMAIL FROM IRCC NIAGARA FALLS OFFICE TREATING MY H&C APPLICATION WHICH IS NOW 20MONTHS , I AM CURRENTLY A PROTECTED PERSON. I DIDN'T APPLY FOR PR YET BECUZ I STILL HAVE PENDING H&C WHICH IS NOW 21 MONTHS .
This refers to your application for permanent residence on Humanitarian and Compassionate (H&C) grounds. We have realized that, since you first applied for permanent residence on H&C grounds, you have been granted protected person or refugee status in Canada. As such, you are entitled to apply for permanent residence in the regulatory class for Protected Persons and Convention Refugees. This class has different eligibility criteria than H&C, which may be of benefit to you. By applying for permanent residence under the Protected Persons and Convention Refugees class, your application can include your family members abroad, who will be concurrently processed for permanent residence (they must meet the definition of “family members” in R(3)). MY QUESTION IS WILL TAKE ANOTHER 2YEARS FOR THEM TO PROCESS MY APPLICATION OR THEY WILL PROCESS MY PR APPLICATION FASTER LIKE GETTING H&C PR APPLICATION ?

In my opinion, applying for PR as a protected person is the best option. That way, you are sure of your PR being approved for as long as there are no criminal or serious health issues.
While for H&C, it’s a game of chance 50/50.
It’s like leaving the known for unknown.
Call them to know if you need to pay another application fee incase they already started processing the H&C.
The decision is up to you.

Need your input please.. When your RPD/RAD got rejected after so long, how did you manage to get past the 12 month barrier for the h&c to be considered ? Just asking as i think my circumstances warrant both h&c as well as refugee success. Thanks and congrats that things are moving well for you.That’s unfair was happened to me for my refugee case they finalized it in 3.5 years and finally got rejected, the main point here if already decided to refuse me why it took so long to get a negative decision! 6 months to one year is fair enough to decide the case either H&C or refugee case
I totally understand but the most important thing here is the surest way to get PR. Taking the H&C option is like gambling. He will need to demonstrate H&C factors and at the mercy of the officer who has absolute right to determine if you’re eligible or not. They say a bird in hand is worth millions in the bush. May God always help us to make the right decision. @helpme1, you should get a good lawyer to put in a Federal Appeal. A very strong appeal takes time to conclude. That way you can buy time.Need your input please..
