Hi everyone, I would like to ask you a few questions and I'll we very thankfull for your replies. The situation is - I am a PR, my card is valid until 2017 (I renew it recently), but I am outside of Canada for a year and 4 months and I do not meet the Residency Obligation. My mother died a few years ago, her husband (is he my father in law?) was very ill when I came back to my home country (he has nobody to take care of him) doctors made him a couple of medical interventions (surgeries), I was taking care of him. Now his health is better and I can leave him in a rest home where someone will take care of him. My question is - if I had a problem on the airport (for my long absence outside Canada) will Imm Of consider that this is H&C ground? What do you think? Thank you!

With a PR card valid until 2017, I doubt you will have a problem at the airport but if you do, I think they will consider your reasons if you can prove them.

Ideally you should return now, spend 2 years to put your status in good standing and then you can do what you want.

1 yrs. and 4 months is not a particularly long absence as you are allowed up to 3 yrs.

Thank you Leon! Do you think if I obtain a letter in English from the doctor will be a good evidence?

Yes, I think a letter from the doctor would be good. If they ask you at the airport, you can show it. Because of the letter, they may decide not to report you if they were even thinking about it in the first place and if they do report you, you could use it for your appeal.
