Hi all, we are just starting our Immigration process but i've come up with a problem. Our story is ...
My husband is Canadian, myself English, we live in the UK where he has Indefinate leave, we have been married for 9 years. Our application is Family (spouse sponsership).I have one dependant child (17years old) who will NOT be coming with us. (He wants to stay close to his father and to go to University in the UK).
Now I have included him in the application, for possible future plan changes. We believe that we can get an up front medical which i think my son also needs to have .... that's fine. The police certificate is the thing... He will be 18 in March ... Any ideas how this will work? I've read that under 18 and living in the same country he doesn't need a police check... but how will that effect things if he turns 18 when the application is in progress?

Hi,

As your sons below 18 years when the application is received at the Case Processing Center, he will be exempted from submitting Police Clearance Certificate. If all other requirements are complete for the application, the file will be transferred to the Visa processing office for their action. There is no possibility of asking a PCC when he gets 18 during the processing period.
 
His age will be locked in at the time Mississauga receive the application.
 
Thank you so much for your advice :) most helpful. So by that same token my other son will be 22 on Feb 20th ... so i need to make sure they receive it after that date or they will want dependant child info on him ?

Hi,

Please note the rule:

A son or daughter is dependent when the child is over the age of 22 and has been continuously enrolled as a full-time student and depended substantially on the financial support of a parent since before the age of 22.

If the application is received by CPC before he attains 22 yrs would be better.
