in what way is the application different

Ummm wait a minute Suin, I don't think she lists her spouse/sponsor under "additional family". I know that is confusing and it confused us as well but I had many people confirm that it's only because the forms are generic (ie you could sponsor your parent or child and they could list their spouse on that form). So she would not have to list her sponsor under "additional family" and as johngills is Canadian citizen, he doesn't need medical or police checks or photos, etc. He only has to fill out/provide the things in the "Sponsor's Checklist".

Am I wrong? If so, then we did it wrong as well!

Ok guys, there is alot of confusion here.

There are 2 places where the applicant is asked to provide information about family members.

1. On page 2 of the Application for Permanent Residence (IMM 0008). Here, in the case of a spousal sponsorship, you fill in ONLY your dependent children that are not already PRs/citizens. You DO NOT include your spouse (the sponsor) here since the sponsor must already be a PR/citizen to sponsor and the instructions ask you to include your spouse/common-law partner, your dependent children and those of your spouse who are not already permanent residents or citizens of Canada. So anyone who is already a PR/citizen is NOT included here since this form is the application for PR and they are not applying for PR.

2. On the form called Additional Family Members (IMM 5406). Here you include ALL of your family members, including your spouse (the sponsor), your parents, your children (including any stepchildren), and your brothers and sisters (including stepbrothers/sisters). You must include the names in English and in your native language (if different).

I hope that clarifies. Good luck.

Nope, it doesn't (clarify (for me)).

We didn't do this. We read the term "Additional" to not include the sponsor, for both forms. I think this ambiguity is CIC's fault. They should make unique forms for the different types of sponsorship scenarios.

Then I'm afraid you filled it in incorrectly. :(

I don't think it's ambiguous. On one you are asked for all of your family members. On the other, you are asked for all your family members who are not PRs/citizens, i.e. include only the people who are ALSO applying for PR with you.

Yes, that's very possible. I remembered that we puzzled over this for a while and I cannot recall for sure, (can't check right now) but I think we didn't put the sponsor/spouse's name in there, so it might be sent back to us since they will obviously see that the applicant is my husband from the rest of the application. How strange.

That's a rather poorly designed form. In most cases I think the CIC did a reasonable job of making things clear, but not for that form. I think I might annoy CIC Berlin with an email about it, as a reward ;) Naaah, I guess if there's a problem they'll let us know.

I found this in the instruction guide (IMM 3999)

For filling in the main application IMM 0008

"Details of family members:
Your family members are your spouse or common-law partner, if applicable, and your dependent children (start with the oldest). You must include all of your family members (who are not already permanent residents of Canada or Canadian citizens)"

Then the only thing they say for the Additional Family Information (IMM 5406) is this:

It is very important that you list on this form any other children (even if they are already permanent residents of Canada or Canadian citizens) that you, your spouse or common-law partner or your dependent children might have who are not included in your Application for Permanent Residence. This includes married children, adopted children, stepchildren and any of your children who have been adopted by others, or who are in the custody of an ex-spouse or ex-common-law partner.

Clear as mud! :D Better dig that up and see what we wrote!

PMM and rjessome give their expert opinions here, confirming again what you said ariell: http://www.canadavisa.com/canada-immigration-discussion-board/-t26970.0.html

The Littlest Hobo: I'm sure they'll let you know if there's a problem!

JohnGills: Keep in mind that your wife's child who is over 18 also needs to fill in his/her own copy of IMM 5406. This is regardless of whether or not he/she will be accompanying your wife. From the guide:

"You and each of your family members 18 years of
age or over, whether accompanying you to
Canada or not, must complete their own copy of
this form"

Parents as well????

Thanks Ariell, just dug it out and my husband filled it in correctly - phew - he's a smart cookie! No wonder he married me ;)
