If you live in Canada or are Canadian/a PR/etc, you do not need to pay the $5 fee. (Select Privacy Act)---but if these do not apply to you, you will need to pay it.

The consent form IMM5544 is a good idea to release all of the info contained on the notes (and required if you are not requesting your own notes)

You have to have some form of residency status (Worker, PR, Citizen) to use Privacy Act to apply. If the PA is not in Canada, or they cannot prove the PA is in Canada, then you can make a request under Access to Information Act :http://www.cic.gc.ca/english/department/atip/requests-atip.asp . That one costs $5.

The form says "If you are submitting a request under the Privacy Act for information belonging to someone else, the individual to whom the information belongs must also be a Canadian citizen, a permanent resident of Canada or currently living in Canada"

From the Privacy Act request page (just above the consent form blurb):

"
Note: Personal information which belongs to an individual who is not a Canadian citizen, a permanent resident of Canada or currently living in Canada must be requested under the Access to Information Act.
"

It's because people who do not have a valid status in Canada's information is not available under the Privacy Act. Reports are that they will request proof that the person resides in Canada, if they cannot find proof on file (eg: Work Permit, PR Visa, etc).

Interesting...as I obtained my notes before I had my Work Permit and they never asked for proof of my address.

Inland application -- expectation you are in Canada ::).

Yes in the GCMS Notes thread, there have been reports of refusals (and requests to re-apply until Access to Information Act) for outland applications who try.

I just applied for GCMS notes for the second time. Yes, you have to pay the $5.00 Cdn.
I forgot to attach a consent form from my spouse this time. Somehow I wasn't thinking, and I assumed since I submitted a consent form the first time it wasn't needed this time.
I think I made a mistake and they likely won't process my request.

They'll contact you if they need it....if you are the Applicant and requested your own notes, they'll just block out the sponsor details.

I'm the Sponsor. My husband, the Applicant is overseas.

You can always email the ATIP email that was provided in the autoresponse and include your tracking number....then attach the completed form. The first time I used the form with the notes, I filled it out wrong and they just had me redo it and send it in...still got the notes on time.
