Gay Immigration In Canada (Crossing The Border)

Hi there,

I am a Canadian citizen. I have lived in Mexico City for the past 4
years and started a relationship with a Mexican man. We are planning to
move to Canada next week and start the process to have him become a
Canadian citizen. I am originally from Montreal but we are going to
move to Vancouver (mostly because my boyfriend doesn't speak French).

I went over the information contained on the CIC website. We are
planning to get married as soon as we arrive and to send an ''In
Canada'' request under the ''Family Class Application Process''.

We don't know what we should tell the customs agent when we arrive at
the airport: should we be straight forward and tell the agent that we
are planning to get married and that I will sponsor my boyfriend until
he gets his permanent residency or should we be evasive and tell the
agent that I am returning to Canada and that my boyfriend will stay
with me while I am settling back. Will anything that we mention affect
my boyfriend's stay in Canada ? Can he even be denied permission to
enter the country ?

oh boy ! not as easy as you think. First of all, your Mexican boyfriend will need a Visa to enter Canada. If im not mistaken, this is not easy to get. Correct me if Im wrong, but i think you can get married in Mexico City.

He definitely needs a visa. He'll need to apply for the visa and get it in his hands before going to the airport. He shouldn't be allowed to board the plane without a visa. Even if you decided to drive to Canada to get around that, he would be denied at the border.

Unfortunately, Mexicans have a poor reputation for abusing the immigration system in Canada (this isn't my opinion, this is based on published articles about the large volume of Mexicans making bogus refugee claims and appeals - trying to ride the system to stay in Canada... NOT about your boyfriend). It's difficult for them to get TRV. You will need an almost flawless application.

If you get the TRV, he can still be denied at the border/airport IF they think he will overstay. If they know he plans to get married to you in Canada, there is a large chance they will think he plans to overstay. It may be best to go through as 'friends' (we're all best friends with our spouse, right?) or go through separately.

Once in Canada, you should look into getting an Inland Application asap so he can remain in Canada while the application is in process (but shouldn't leave for any reason).

If you've lived together for at least a full year, you can also apply as Common-law. You may return to Canada and still sponsor him as long as the year requirements are met. This will allow him to come to Canada as a PR, then you can get married in Canada if that's your preference.

Welcome MundoF, As stated it's going to be really hard to get a TRV specially if you do tell them of your plans to marry. Quick Question... are you returning to Canada just to get married and sponsor? As a Canadian Citizen you do not have to be in Canada to sponsor and you can remain with your spouse until he receives his PR visa, you will have to include a letter of intent and evidence proving you intend to return to Canada as soon as your spouse gets his PR. Edited to add: According to CIC it's taking 10 days to process TRV's but there are alot of stories it could take longer. When applying it would be best that he shows strong ties to Mexico... family, job, lease, bills, schooling anything that shows he will return as that is the biggest obstacle, once he is in Canada then you can apply In-land before his TRV expires also file for a OWP at the same time and he will then have implied status until a decision is made on his application. again Good Luck!
