Hi there,

I've started working for a banking client via another consultancy, who treat me as an independent contractor. So, the consultancy pays XYZ incorporation (My sibliing: Head and Director | Me: Co-director) hourly wage + GST/HST. My sibling treats me as full-time employee and pays me monthly salary, pays the taxes to CRA and will provide a T4 at the end of the year.

As he has recently established the incorporation, it's still a numbered one. However, he is planning to get a new name to his business and start hiring more candidates.

So, when I apply for CEC, can I provide employment letter from my sibling's numbered incorporation? or does the numbered corporation needs to be changed to a named corporation and should have a proper website? Also, request you to provide any challenges I may foresee in this situation.

In my personal opinion, even with all the legal papers you may have, your relationship as an employee with your sibling seems irrelevant and your actual role, the one that matters seems to be you as "co-director" or co-owner of this 2-people incorporation. And therefore since self-employment doesn't qualify for CEC it doesn't look like you meet the minimum requirements.

But that's just my opinion so you might want to check with a professional lawyer for this unusual situation you have.

On the other hand, I'm curious to know if this would have worked when I'm not the co-director of the incorporation? Could you please advise?

not really, you´re still "working" for your sibling, it looks difficult to prove that that's really professional and not just some cover up for immigration
