Hi, Guys

the wife and I got married in April 2012 and I just wish to get things correct..on the forms...before we got married we signed a lease which started a month before getting married ( lease started march ).

* I'm a UK citizen and been coming back and fourth from England since 2010 and never overstaying my tourist Visa

* Last year I came into Canada in Jan 2012 to get things ready for the wedding - given six months on my passport in the 5 months we got married ( april ) and we left the country before my visa was up and went on Honeymoon -- we entered canada ( august ) and was given another six months

so basically we been living together since april as I lived in the leased place for a month on my own in March.



I have now returned back to UK and wife is on her own in Canada - while we sort forms and I do meds we are applying outland

so can you guy's advise me on these questions.


* her sponsor questionnaire IMM5540

* QUESTION 12 - are you living with someone ? should she put me - but I've returned to the UK now?

question 12 - previous countries of residence have you lived in another country other then your country of citizen for 6 months or longer

Do I put the dates - from when I entered canada last year jan - left in 5 months entered back in august left in Jan?

QUESTION 12 - ADDRESS - LIST all address you have lived since 18

do I put the canada address where we are leasing?

Hey, and welcome!

not sure you are aware - but as you are from a visa-exempt country, you can stay on a visitor visa (same as before) even when you're applying for outland PR, you don't need to leave the country.... and you could do the meds anywhere in the world, including in Canada.

NOt sure what your question is though - which forms are you filling in now, and what is your question? you've not done anything illegal, and so you can just put all the information ( about you being in Canada) as it is here, and it will be fine...it will serve as an extra proof of your relationship.

you can explain the situation - you have lived together from that date to that date, and now you are in the UK gathering proofs for the PR application and you intend to return on that date...

Or - if you don't have a return date - because you're only going once you have the PR - then you can put no, but still explain the situation.

contact information mailing address - should I my put home address UK Or canada address? up to you - will you be returning to Canada soon ? if yes, then put this one - that's where they will send correspondence... if your wife is living there anyway and it will be your final address, it might be easier. But if you prefer to put your UK address because you will stay there until the PR is approved, then put the UK address. it can be updated later on, so if your situation changes, that's OK

Will I need another police report from Canada

As I stayed in Canada for 5 months one time and then another 5 months in one year since getting married

So total 10 months ? In one year leaving before my six month visa ended and reentering and given another 6 months

Welcome to the forum.

I would not say that you resided in Canada, technically you didnot reside there , you are on a tourist VISA, and tourist VISAS mostly are not more than 6 months, in many countries more than 6 months VISA is considered as residents such as student, permanently residents, work visas and more. But your visit was 5 months each time

Also Many countries don't issue police certificate for non-residents I am not sure of Canada. YOu can check with the RCMP Police.

For example every year i go to Malaysia for 3 months to stay with family members on a tourist visa not a resident VISA, If i sum up for the last 4 years it will be one year, should i say i resided in Malaysia ?

So from my understanding is that they are looking for a country you were legally admitted as a resident not a tourist.
and in this case you don't need a Police certificate since your a tourist visa and you didn't stay longer than 6 months, but you can still request the RCMP Police for the certificate all you need is submit your fingerprints.


You can explain that you visited your sponsor twice and you stayed with her 5 months each time and also show the proof of tickets and entry and exit stamps.


This is just my understanding others will also share with you their experience

You do not need to get a PCC from Canada unless asked by CIC. At present, background checks are usually conducted internally by CIC. In some cases, fingerprints are requested and you will be informed, if it is needed. In future fingerprints may become mandatory though.

I thought it would be ok to say I was in Canada with my wife after we got married?

Won't cic know when I have been in and out of the country when they do background checks on me?
surely by my passport info will pull everything about my travel into and outta Canada?

If you stayed in Canada with your wife after marriage, it is okay to say you were in Canada. If you traveled outside Canada for short periods, give that information under question for travel details.
 
Thanks - being with my wife after marrying -- I thought would show we are in genuine relationship
I have the lease for our condo we signed before marrying home insurance under both names


Would like to be honest - as I never overstayed on my visa - just wanted to be with my best friend my wife
 
It is a good thought and staying together is definitely better than being apart. Lot of applicants do the same as you. So enjoy...Take Care.

in a few weeks - what's the safest thing to write?

Also form IMM 0008 question 10 - current country of residence ? Should I write UK or Canada

As suggested by sweden earlier, if you will be returning to Canada then you can write your Canadian address but if you will stay in UK until your PR is approved then write your UK address. It is up to you and you will be able to change the address later if you want.
