My NOC is 2273 and all my experience would fall under the same NOC.

Following is the breakup of my work experience for the past 10 years which has been contractual with different companies.

COMPANY A

01-Nov-07

01-May-08

5 Months 29 Days

23-Aug-08

29-Jan-09

5 Months 6 Days

UNEMPLOYED / STUDYING IN SINGAPORE

27-Feb-10

27-Jun-10

3 Months 28 Days

11-Aug-10

18-Oct-10

2 Months 7 Days

03-Mar-11

24-Aug-11

5 Months 21 Days

COMPANY B

29-Dec-11

25-Jun-12

5 Months 26 Days

18-Aug-12

04-Dec-12

3 Months 16 Days

COMPANY C

30-May-13

31-Dec-13

7 Months 2 Days

COMPANY D

18-Apr-14

17-Aug-14

3 Months 29 Days

14-Jan-15

19-May-15

4 Months 3 Days

15-Jun-15

27-Aug-15

2 Months 12 Days

Total experience is about 4 years. I would be able to get a letter of reference from each company stating my duties and attesting the above experience where I worked for more than 56 hours per week during the said period.

My question is, since there is no such clause as continuous work for work experience outside Canada, will I be able to claim for the maximum 3 years of work outside Canada. As per my understanding work of more than 30 hours / week is considered full time work.

Kindly advise on the above dilemma if you have the time.

Thanking you,

You need a year of full time continuous work experience in order to be eligible under the FSW program.

You do not meet that requirement.

Hi DelPiero07

Please refer to the following:
Full-time work
(5) For the purposes of this section, full-time work consists of at least 30 hours of work per week.

Foreign work experience
25 (1) For the purposes of sections 23 and 24, foreign work experience is work experience that

  • (a) is acquired by a foreign national outside Canada in one or more occupations listed in Skill Type 0 Management Occupations or Skill Level A or B of the National Occupational Classification matrix;
  • (b) consists of full-time work experience, or the full-time equivalent for part-time work experience, with one or more employers;
  • (c) is acquired within the 10-year period preceding the day on which points are assigned to the foreign national under section 23 or subsection 24(1); and
  • (d) is remunerated by the payment of wages or a commission.
The above are excripts from the following website:
http://www.cic.gc.ca/english/department/mi/express-entry.asp

Kindly correct me if I was wrong in my initial deduction. Is there something iam missing. On that website there is no mention of the word "continuous"

Thank you. Your help and suggestions are much appreciated.

Your work experience must be:

  • in the same type of job as your primary NOC
  • within the last 10 years
  • paid work (volunteer work, unpaid internships don’t count)
  • at skill type 0, or skill levels A or B of the 2011 National Occupational Classification (NOC)
  • at least 1 year (1,560 hours total / 30 hours per week), continous
    • full-time at 1 job: 30 hours/week for 12 months = 1 year full time (1,560 hours)
    • equal amount in part-time: 15 hours/week for 24 months = 1 year full time (1,560 hours)
    • full-time at more than 1 job: 30 hours/week for 12 months at more than 1 job = 1 year full time (1,560 hours)

Continuous for 2 years assuming 15 hours per week.

Count whichever part time work experience you have from August 2012 to before you started your full-time job in October 2012 and add it to the rest

So you have 2 years and 10 months + your part-time experience from August 2012 to before starting the other job.

I didn't even realize the continuous condition on work experience when I applied. I took 3 months of parental leave and returned to work for a few weeks before I attained the qualifying 12 months work experience and applied for PR. My work experience was thus not continuous, but maybe IRCC treats parental leave differently?

So did IRCC count your work experience as continuous? I am just curious as I am not allowed to work full time for more than one year by law. I intend to apply with a letter of explanation.
Do let me know as I want to find out if IRCC makes exceptions in some cases.
Thanks.

Perhaps, I haven't been able to find much regarding maternal leave so I can't comment on that.

IRCC does make exceptions if the nature of the applicant's job prevents him/her from having a year of continuous work experience (teachers for example).

Thank you DelPiero07 for the quick response.
If the IRCC had the powers to make stock decisions then I think I will start working on my letter of explanation for the same.
Cheers
