Hello,

I had applied under the FSW category in June 2014. I had got my medical request in FEB 2015 & got the medical done of all the applicants on 3rd March 2015. Almost 1 week later, my third line was updated stating that :- Medical results have been received. Can you please let me know how long does it takes to get the passport request. Some of my friends had got the mail for passport exactly 40 days after their medical was done. Please guide.

The skilled worker class-action has been taken over by a lawyer hired by Leahy, Rocco Galati.

Leahy's press release of last week [22 January 2015], in which he discussed his disbarment, was issued primarily to announce that the 1,300 skilled workers - 208 of them Chinese - were finally to get their day in court on April 21, more than six years after they were removed from Canada's immigration queue. In 2008, the then-immigration minister Jason Kenney scrapped their applications and about 80,000 others amid a massive backlog in the federal skilled workers programme, Canada's largest immigration scheme.

The skilled workers' case will be heard by the Federal Court in Ottawa, which last week granted leave for a judicial review. They are seeking to compel Citizenship and Immigration Canada to process their applications for permanent residency. Some of the 1,300 litigants applied to immigrate as long ago as 2004.

“If the litigants prevail ... all the closed skilled worker files will be resuscitated, opening the door to Canada to 200,000 [applicants and dependents] who entered the immigration queue between 2004 and February 2008,” Leahy said.

The skilled worker programme was frozen in 2012, then relaunched in 2013 with a new points grid and a system to better assess educational credentials.

In February 2013, Citizenship and Immigration Canada took the unusual step of issuing an internal operational bulletin to its staff, warning them that Leahy had recently been suspended. It reminded staff to ensure that immigration representatives “are members in good standing of the regulatory body which governs them”.

In a public posting on a LinkedIn discussion board, Leahy said the bulletin was “just par for the course at CIC”. “It's neither the first, nor will it be the last salvo, from CIC, and it has not, and will not, cow me. In time, matters will be righted,” Leahy wrote in 2013.

Justice Robert L. Barnes of the Federal Court of Canada, after having unlawfully sidetracked the applications of 1,300 federal skilled workers, has finally deigned to allow their cases to be heard. The litigants joined the UnfairCIC.com group Tim Leahy organized in October 2011, asking the Federal Court to order Immigration Canada (CIC) to process their files, which then Minister Jason Kenney had set aside in 2008 so that he could boast that those who had applied during his tenure were being processed efficiently. They had lodged their applications from 2004 to February 2008 and consist of applicants living on each of the inhabited continents.

In February 2012, CIC and Tim Leahy signed an accord, filed with the Federal Court, pledging to apply the decision in the lead case to the other cases. However, on 29 March 2012, then Minister Kenney announced that he had tucked into the Budget Bill a provision trashing 80,000 skilled worker files, affecting nearly 200,000 people. CIC had made that decision the preceding fall but concealed that fact from the Federal Court and Tim Leahy when it promised to apply the decision is the lead case to the other files.

In June 2012, Justice Donald J. Rennie ruled in the litigants' favour in Liang but, because he was afraid to extend his ruling to all the litigants lest he so alienate Jason Kenney that he would never be appointed to the Federal Court of Appeal, he opted not to order CIC to process the litigants' files. Instead, Justice Rennie feigned a belief that Jason Kenney would honour the pledge he had made to the Federal Court to apply the ruling in Liang, 2012 FC 758, to the other cases.

Justice Barnes refused to require CIC to keep its word to the Federal Court. Instead, Justice Barnes ordered Mr. Leahy to file a motion seeking enforcement of the Agreement because he knew that the files would be closed before the motion could be decided, evidencing yet again his bias against the skilled worker litigants and especially his animus toward their lawyer.

In refusing to honour the Agreement, CIC lawyers lied to the Federal Court, asserting that Mr. Kenney would be acting “contrary to law” if he behaved honourably. On 29 November 2012, Mr. Kenney proved that his lawyers had been lying when he ordered visas be issued to a few dozen skilled worker applicants whose files had also been closed but who had been issued visas afterwards in error. If they agreed to return their visas for cancellation, he promised to create a new file number and re-issue them – exactly the authority Mr. Leahy had said that he had – see Operational Bulleting 479B. http://www.cic.gc.ca/.../re.../manuals/bulletins/2012/ob479B.asp

When he refused to enforce the Agreement, Justice Barnes consigned the unfairCIC.com group into the so-called class-action, initiated five months after the unfairCIC.com litigation, to challenge the closing of the files. On 9 December 2012, Justice Rennie, who was assigned to the so-called class-action, refused to allow the unfairCIC.com group to seek enforcement of the Agreement at the January 2013 hearing because CIC's counsel Martin Anderson had told him to limit the hearing to what CIC wanted to be decided. By so doing, Justice Rennie turned the law on its head, ruling that the defendant, not the plaintiff, determines what issues are to be presented.

Therefore, Mr. Leahy filed the first case of 2013, IMM-1-13, seeking an order to enforce the Agreement. After having perfected this case, Mr. Leahy set down a motion, asking the Court to join the 1,300 other litigants to IMM-1-13 and to set a hearing date. The motion was to have been decided on 9 July 2013. However, after Justice Department lawyer Jane Stewart objected to the motion being heard, Justice Judith Snider dutifully struck the motion off the hearing list without permitted Mr. Leahy to address the issue, and Justice Barnes, contrary to Court protocol, instantly seized the case and refused to allow it or the other 1,300 cases to proceed.

Chief Justice Paul Crampton endorsed this unethical conduct and, when Mr. Leahy, asked him to remove Justice Barnes from this case, retaliated by filing a complaint with the Law Society against Mr. Leahy. The Law Society refused Mr. Leahy's request that it turn his complaint over to an independent legal expert to ascertain whether Mr. Leahy's accusation had merit. The refusal of the Law Society's Damianne Lebrun-Reid to come to the assistance of these 1,300 litigants allowed Justice Barnes to continue denying them justice for over two years. Instead, Lebrun-Reid ordered Mr. Leahy to give her the telephone numbers and email addresses of his litigants so that she could tell the 1,300 litigants that she was investigating Mr. Leahy for unprofessional conduct.

Lebrun-Reid's erstwhile superior, Zeynep Önen, endorsed the refusal to assist the victims of Justice Barnes' vendetta and the effort to destroy Mr. Leahy's reputation and practice. On 9 December 2014, the Law Society's quislings, Christopher Bredt, a partner at Borden Ladner Gervais LLP, and Heather Ross, who runs her own firm in Goderich, ruled in favour of the Law Society henchmen and did as their prosecutor, Anne-Katherine Dionne, had directed: they disbarred Mr. Leahy.

After leaving 1,300 litigants without the lawyer they trusted, Ms Dionne, Michael Elliott and their stooge, Laura Donaldson, refused to provide them with a lawyer but, instead, had the Ontario Court close Mr. Leahy's practice when they knew that Mr. Leahy was out of the country. A year earlier Justice Robert Barnes' unethical and unlawful conduct had become too much even for CIC to bear, prompting Justice lawyer Martin Anderson to notify him in January 2014 that CIC wanted the matter to be heard in May 2014. When Justice Barnes ignored his letter, Mr. Anderson asked for a case conference. At the March meeting, Justice Barnes said that the hearing would be in September 2014, but yet again Justice Barnes elected not to keep his word.

At the hearing on April 21st, the litigants will be seeking the Court to order CIC to honour the February 2012 Agreement and process their files. If the Court accepts its responsibility to order CIC to honour its promise to the Court, the decision will affect only the 1,300 litigants. However, if the Court rules instead that CIC may lie to it with impunity, it will have to address the second issue: whether the closing of their files was unlawful. The argument Mr. Leahy formulated, the counsel in the so-called class-action litigation, Tabingo, ignored. Thus, the dismissal of the Tabingo litigation may not lawfully affect the unfairCIC.com litigation group. In addition, an argument which Rocco Galati made in Tabingo but which Justice Rennie chose not to address, will also be front and centre. If the litigants prevail on any of these issues, all the closed skilled worker files will be resuscitated, opening the door to Canada to 200,000 people who entered the immigration queue between 2004 and February 2008.

Hi Seniors, Im NOC 1123 candidate applied in December 16th (App received date) believing the last cap update of CIC. I have not received any information after that and my DD also not encashed yet. I heard that this NOC was capped on 20th October 2014 which is contradictory to the last update of CIC.

Suppose if I receive my application back from CIC without being considered, could I seek legal assistance ?

Victory For Quebec Skilled Worker Applicants

Thousands of Canadian immigration applications may be affected by court decision

The Superior Court of Quebec has arrived at a decision in the case of Stasenko v. MICC et al, which challenged the government of Quebec's decision to apply changes to the Quebec Skilled Worker Program's (QSWP) eligibility criteria retroactively, having previously promised applicants that their application would be processed based on regulations in effect when it was submitted.

Legal proceedings were initiated by the law firms of Campbell Cohen (David Cohen) and Irving Mitchell Kalichman (Mathieu Bouchard) in an effort to prevent the government of Quebec from applying new immigration regulations retroactively. The decision centred on the principle of promissory estoppel — the legal principle that a promise is enforceable by law when the promisor (person making the promise) makes a promise to the promisee (person being promised) who relies on it to his or her detriment.

This important decision represents a victory for thousands of applicants whose applications for immigration to Canada under the QSWP may have been affected by regulations introduced by the government of Quebec that came into effect on August 1, 2013.

The background
In February, 2012, Quebec released a document checklist for the QSWP. No such checklist existed before this date. A key sentence of this checklist stated ‘your application for a selection certificate will be processed based on regulations in effect when it was submitted.' This sentence was removed from the checklist in May, 2013.

The QSWP is a points-based Canadian immigration program. Candidates are assessed according to various selection factors, such as language ability and level of education, and awarded a certain number of points based on these factors.

The government of Quebec enacted new regulations that came into effect on August 1st, 2013, the combined effect of which significantly changed the way points are calculated under the QSWP. Among the changes made to the points system were changes to how points were to be awarded for language ability. Whereas previously applicants could be awarded points according to their language ability, even if their abilities were basic or intermediate, the new regulations determined that points for language ability could only now be awarded if the applicant could prove an advanced-intermediate ability.

These regulations were applied retroactively to all applications where preliminary processing had not yet begun, meaning that these applications would be assessed according to the new points system, despite the promise made to applicants that their application for a selection certificate would be processed based on regulations in effect when it was submitted.

By the end of June, 2013, there were more than 50,000 affected applications for a selection certificate under the QSWP that had been received by the government of Quebec. Many of these applications had been submitted while the terms of the original checklist were in effect.
The only transitional measure put in place was to allow applicants who had submitted their applications between July 8 and August 16, 2013 to withdraw their application voluntarily and obtain a refund.

The case
A case against the government of Quebec was brought by an applicant who submitted an application for immigration to Quebec through the QSWP on April 9, 2013. The applicant, a Russian citizen, was a client of the Campbell Cohen law firm, with Attorney David Cohen as her legal representative. Her file was opened on June 20, 2013, and the Minister notified receipt of her processing fees, which came to CAD $910.

The changes made to the language proficiency requirements, which came into effect on August 1, 2013, meant that the applicant was unlikely to be eligible when it came to the preliminary processing stage of her application. Under the points system in place when her application was submitted, her chances of being assessed positively and being called for an interview by the government of Quebec were excellent.

On April 21, 2015, the Superior Court of Quebec made a decision in favour of the plaintiff and ruled against the government of Quebec. The government of Quebec has 30 days to appeal the decision.

What this means for applicants
At this time, it remains to be seen if it is only those applications that were submitted while the original document checklist was in effect with the key sentence ‘your application for a selection certificate will be processed based on regulations in effect when it was submitted' that may benefit from this decision. These applications would need to have been submitted between February, 2012 and April 2013, inclusive, and not yet have reached preliminary processing by the time the updated regulations came into force.

If these applicants wish to have their case for a selection certificate through the QSWP reassessed based on the points system in effect at the time of submission, they may be able to do so as a result of this case. A broader interpretation of the ruling could affect a greater number of applications submitted before February, 2012.

“In any event, this case is likely to have affected thousands of applicants who, in my view, were wrongly denied the chance to have their applications for immigration assessed with fairness. That is why I was proud to be co-counsel in the legal efforts against the government's decision,” says Attorney David Cohen.

“One would have thought that only those applicants who applied on or after August 1, 2013 would have been subject to the changes, but this was not the case. Changes were applied retroactively to candidates who applied, in good faith, months beforehand, under the impression that their application would be processed based on regulations in effect at the time of submission, as per the document checklist for the program.

“With a favourable decision based on the principle of promissory estoppel, these applicants may yet be able to realise their Canadian immigration aspirations through the Quebec Skilled Worker Program.”
