I can not understand why the CIC favors those who joined the lawsuit before June 15th? we are all applicants with the same complaints,,,same problem,,,
The thing is CIC never bothered to inform any pre2008 applicant personally of the file closure,,,all of us have their file status in process,,,no mail or e mail was sent to those affected by the negative decision, resulting in delay of reaction of those applicants as well,,,I bit thousands, if not tens of thousands of applicants are still unaware of the situation till the moment,,
SHAME ON CANADA; TREATING PEOPLE LIKE THIS!

Hi everyone, this is a reply i've received from Attorney David Cohen yesterday:

Dear Christo,

I hope that you are doing well.

This email is to update you on the Class Action court proceedings. Back on June 29, 2012, the Federal Court ordered Citizenship and Immigration Canada (CIC) not to terminate the applications (and return the government processing fees) of the individuals who had applied under the Federal Skilled Worker (FSW) category prior to February 28, 2008 and who had not received a selection decision by March 29, 2012, for a period of 90 days.

The 90 day “Stay Order” will be coming to an end near the end of this month (September). As we don't expect to be heard in Court on the Motion for Certification as a Class Action before sometime in November, we are going back to Federal Court on September 18, 2012 to seek an extension of the “Stay Order” in an effort to prevent the government from beginning to terminate applications.

The probably outcome of the September 18, 2012 Court hearing will be one of the following:

· A new Stay will be granted for the entire class of FSW applicants;

· A new Stay will be granted for only those applicants before the Court;

· A new stay is not granted and the proceedings continue without a Stay in effect.


Once the Court decides on this issue I will advise you further.

I found this latest update from the CIC website. Got a bad feeling, it doesn't look good to me..:(
Hope we can get update asap! It starting to get into my nerves. Hate this anymore!

Hello Everyone,

1. My understanding from the events is that we cannot expect a court judgement on the "class action" as of now.
2. The hearing yesterday (18th Sep) was an effort by the lawyers to force a status quo on the CIC, by not letting them terminate the applications by enforcing a stay order from the court. The outcome of the same is yet to be known, and surprisingly the websites of Bellisimo Group and Cohen Group are silent on the issue.
3. As far as I am aware, the class action proceedings will commence sometime in November.
4. My guess is as good as everyone else's...and so is my hope...that our applications are not terminated.
5. Almost all of us have their fingers (and toes as well) crossed..with a prayer that our name figures in the elusive 20,000 group.

I just hope our lawyer will send us email so that we will not be wondering whats the status of our case. I was pathetic the whole day checking the web for any latest immigration news.
