Have you updated documents back 2008, if no then it is very much possible that your cheque is on way. either of seldec/psdec must be +1 to go ahead.

Doesn't matter much coz i have applied in new FSW hope this time it wouldn't take that much time like 2006 cases . my file should reach this week at CIO.

Hi GSP, Irrespective to whether an applicant of 2004 appealed or not, none is getting such letter or refund. Only few whose ps is zero are getting it. So nothing for worry. Excluding you I know eight 2004 persons and none has received it. I hope You can conclude some thingh useful from these details.

I applied in April 2004 updated the status in nov 2008. No letter from CIC i am not a litigant. Hoping against the time........................

This is random and i got proofs on it... i know 4 applicants who applied along with me (2006 )who i believe will not have PS1 has not received the same..2 of them have applied well before (2005)..well i decided to make my second attempt since New NOC falls under my current profession, what would be annoying is don't want to wait another 7 years for a result like this ( yes or no in 1 years time ). Hope Kenney Boy this time wont mess around with New FSW applicants.

Were you able to log on ECAS before now as a Pre-Feb 27 2008 backlog applicant? Which year did you apply as a backlog?

Yes, I was able to log on Ecas ...earlier the site was showing as DM then Blank. I applied in June 2006 and I filed case against CIC in Oct'11...among those with whom CIC breached the written document and in January Tim again filed a case under IMM-1-13

hello everyone,

I have got an email from Tim regarding CIC requesting for submission of address for refund cheque‏
. I am among those litigants who are the part of Emam contingent. I have not received any letter from CHC regarding updation of address or for any refund. so do I need to go online myself and fill the form or wait till I receive anything from CHC. Please advise

You should wait for any communication from cic before lodging claim for refund.

I am surprised and pained also about the latest situation . On the one hand tims case is still not decided ( emam group) and the litigants getting refund advise from cic without any fear of Honable court. In india this does not happen and status quo is maintained untill some direction is given by court.How it is possible for cic to send refund advise when the matter is under prejudice.

They can do any thing….They breached the agreement “Whatever court decide on sample cases the same should be applicable on rest of the litigants”. If initially we lost then they apply the decision on all 800 litigants but somehow DoJ gave decision in our favor and now we are still fighting on this issue. At least they should honor the written agreement. I heard foreign countries courts are gave fair decision (Ironical)

Bad news - I have applied in 2006 as FSW and got letter yesterday about the termination and returning of fees. Letter saying that pre 2008 cases will terminated.


Is that letter reached to all FSW applicants??

now i see that there is a flow of letter on refund, 6 people whom i know have received it... so it looks like pre 2008 is now heading for refunds, for those who has not all the best..

To the group:----- i have sent mail to FSWFeeReturn@cic.gc.ca for Return of Processing Fee, Right of Permanent Residence Fee or Right of Landing Fee filled.

Lets hope the return fee doesn't take another 5 years

My New FSW Application has reached today in CIO hope this time there wont be any delay ( 5-6 years ) keeping my fingers crossed.

We should not get panic by these letters of refund. CIC is playing mischiviously by obeying justice berens instructions. i am sure they will not return money to all except few unlucky.Litigation is under subjudice.wait for few more days to be more clear.
