Facing An Emergency Issue about Renewel of pr card

Hi Sir... Please Guide me...
Became a permanent resident of Canada date= 23 july 2008
23 july 2008 to 23 july 2013=Out of Canada Days 1098 + In Canada 720 + Travelling days 7=1825

Applying for Renewel of card date 13 Oct 2013 to Back five year 13 Oct 2008= Out of Canada days 1098 + In Canada days 714 + Traveling days 7=1819

Expiry of Pr card date 31 dec 2013 to back five years 31 Dec 2008=Out of Canada 1098 + I n Canada days 716 + Travelling yas 7= 1821

NOTE= 1819 & 1821 total digits are because of some months are 30 & some are 31 days


Note=During 4 times long travel (for mother unstable health & her death & father,s heart attack)because of stays @ airports & In flights (Going back to home country or coming back to Canada)= 7 days



if we calculate between five years time, I can hit 730 days If I will apply in 2 February 2014 only

Important Note... If I calculate by the date I became permanent resident of Canada (23-july-2008 to applying date 15 October 2013) then total days in Canada are 805 days

My father,s heart operation is expected in 16 December 2013
Card expiry is 31 December 2013
Ticket I have bought already
Should I apply for renewel or not? or should I wait for 1 February of 2014
Please guide me with ur moral support...will be Thankful to u...!

I suggest you wait until you have 730 days in February.

You can only count the days back from the date of application if you landed more than 5 years ago, which you did.
If you don't have the correct number of days, you should not apply to renew your card, or you may end up being reported and potentially lose your PR. In your case, you might have an H&C defence, but it's always a serious risk.

I got the meaning of H & C... if I will apply in February.. even that time I will have to face the H & C or in February there is no issue or problem

& the last question my card will expire @ 31 December 2013.... so time between 1 January 2014 to 1February 2014... govt of Canada will count my days in Canada or not? because my card was expire...

Mistake= I have done a mistake that I have paid online 50$ fee of renewel.... but after that I noticed that my 730 days are not complete in Canada.... means will they register me from the date I have paid the amount ( 13 October 2013)

There should be no problem if you meet the residency obligation of living in Canada for 730 days (in February 2014) before you renew your PR card.

You just paid the fee early and I guess you won't receive any calls from them about the early payment. Don't feel bad for paying early. Anyways, keep the receipt in a safe place for now and send it with your PR renewal application together with other supporting document in Feb.

thank you for reply... one intresting thing I want to know... I came in Canada 23 july... my first pr was lost by mail ... I applied in December 2008.. I got in december 2008... but with my new expiry card they did not put expiry date 23 july 2013... they have put 31 December 2013... it there any plus or negative point for myself rite now or in February?

Immigration only counts the 5 year period before you apply so there is no plus point having a PR card that is valid a bit longer except that it won't be expired. Better let your PR card expires and apply with enough days.

By the way, there are no "traveling days". There are days in Canada and days outside Canada. For PR, any part of a day spent in Canada counts as a day within Canada so if you left on a flight that was leaving Canada after midnight, you have spent that full day in Canada even though it was only half an hour and if you arrived on a flight that landed at 23:30, you have spent that full day in Canada even though it was only half an hour. Full days spent in transit on your way to your destination would be days outside Canada.

For example, if you left Canada on April 17th at 5 am, had a 1 day stopover in London because the plane broke down and arrived in your home country on April 19th, you would count April 17th spent in Canada and April 18th outside Canada. If you arrived back in Canada at 11 pm on May 20th, you would count May 20th inside Canada.

Hello

Mistake... I call cic call center. I have discussed all my matter with him. he checked all info with my PR Card Number. He was looking for the expiry date.After that He suggested me like u that don,t apply & wait for 1 February 2014, Every thing will be fine. Should I stay stuck with the feelings of fear that the representer will report me & they will use this call recording against my application on 30 January 2014.

Concern... I don,t have any kind of criminal record anywhere . Application date 1 February 2014, my days will be over then 735. Shall I have to face any other objections or I will be good to go on?

Just relax .. Hold on to February.
