Hi All,

I am new to this forum and I wished I had come across this wealth of information sooner! My wife and I applied for me under inland spousal sponsorship. The application was received June 21, 2012 and they started processing our application October 23, 2012. She is a Canadian citizen and I am an international student. I tried to apply for an extension for my student visa but ran into problems because my wife had twins and I couldn't register for full time studies (because that would have been too brutal) due to the nature of my courses. An immigration officer called me and said that they would give me a TRV instead and that I could re-apply for my student visa when the TRV expires. My issue is that my student visa was set to expire next year July and I have not yet recieved the TRV. We are sending in the application to update CIC about the birth of our twins as well as send in additional photos and such. I didn't know I could apply for an extension for my student visa with our application nor did I know that I could apply for an Open work permit either. I suppose my problem is that I do not know if I am able to send in a request for an Open work permit if I have not yet received my TRV. I also don't know if not sending in the application for the extension with our spousal application is going to affect me negatively down the road. I am confused and worried that I am not going to have any status when they are processing our case :-[ Please Help!

Not to worry, you are on "implied status" now for the duration of your application for PR. Once you get Stage 1 approval (that's "sponsorship approval"), you are eligible to apply for an OWP. I'm not sure anymore when you send that in, I've heard both here i.e. 1) send it "with" your application for PR 2) send it after you have "sponsorship approval". Someone will comment soon . . .

Thanks for replying truesmile! I guess I should clarify. I sent in my application for PR in June. Then I realized that my student visa was going to expire (back then stage 1 said 11 months. So I thought I wasn't going to have status when my application would start processing. So... I went online and applied for an extension on my student visa. I didn't attach this to my application. It was a separate so that is where my concern was. I guess I am kinda out of it. Kinda have a fear of governments (my family immigrated to america when I was 8 and I was an illegal alien for 15 years). So I basically lived in fear of deportation. Even though our relationship is real I just don't want to lose everything due to technicalities. I hope I am making sense lol. I am a bit sleep deprived because our twins are 2 months old now! It is a lot of work but a blast! Thanks again :D
