Long story short. I'm looking for a little guidance. I am a Canadian citizen, I met my boyfriend here in Canada who is an Italian citizen. He is a visitor and his passport is stamped until August 1, 2014. He will be applying for an extension within the recommended 30 days so we can "explore the relationship", my question is this...if we leave July 16 for a vacation to Jamaica and return to Canada a week later will there be any issues for him coming back into Canada? Any words of wisdom is appreciated. Thanks!

If you can show that you have applied succesfully for a restoration and a decision is still to be made then there should be no problems.

CIC will give you an application number if it was accepted. Carry it with you.

1. The OP's boyfriend is applying for an extension, not restoration.
2. Soon as he leaves Canada, his visitor status ends. When they return from their holiday, it will be up to the CBSA officer whether to admit him and for how long.

So even if he applies for extension he could still be refused entry?

I'm not sure if this helps you but I am in the same position as your boyfriend - having been in Canada with my Canadian partner for 9 months I've now got a visitor record for a year and have been quite worried about leaving Canada but can no longer avoid it.

When I called the CIC they seemed to think it was acceptable to go on vacation or a trip overseas and return, explaining the situation on re-entry, but I can see why you are nervous as I'm sure he will be quizzed on re-entry and that's not fun and quite nerve-wracking.

I'm a little confused by the previous answer however as I was under the impression that unless there's a big problem the fact that you've done the paperwork properly and have been allowed to stay in your case until August, should mean he can leave for a trip and return?

i can give you an example from my own experience, though it doesn't involve an actual extension, just a stamp in my passport.

back in feb i visited my husband and asked to stay until a certain day in march. the border agent actually gave me a few extra days (As they tend to do), and i found out 2 days later i had to go back home for a mandatory work related thing. i drove home and back in 2 days, and when i got to the border again, the agent saw i already had a future date stamped in my passport, so i just explained the situation and he let me in no problem.

while it's understandable each entry is it's own entry, if you already have permission to be there for a future date, and you had to leave for specific reasons related to your home ties, i don't think that is that big of a concern to CBSA. Again, as always, it's dependant on the border agent you encounter each time. perhaps it's different for extensions and if you've already been there long term, though i'd lean toward the belief if you already have permission to be there for a future date, they will allow you back in.

Thanks rhcohen2014 that's really helpful, and that makes sense - in my case I'm leaving for a work trip and would have a contract as proof, not sure if the OP's vacation makes it any different. As you know it's just always so worrying to think you may be separated from your partner by being denied entry.

Thank you so much for the examples, it is very helpful.

Your entry is valid to the date annotated or 6 months. If you travel out/in Canada to the USA the entry is not renewed, it is continued.

This is true for people that were given 6 months, leave for two weeks to the USA in month 5 and expect to have 6 more months when they get back (for a total of 11). They still have to leave at the end of month 6 or apply for an extension.
