Hello,

I am planning to apply through EE under CEC, but am in a very critical situation. I have gained one year of canadian experience, but my work permit has expired in the month of dec, 2014. My employer has applied LMIA in the month of august, but we are still awaiting for a decision to made on the LMIA. Also am not elgible to work right now bcoz my WP has already expired. But I will be elgible to work when my LMIA gets approved and also my employer is willing to hire me back. Do you guys think that I can still apply for EE?
 
EE doesn't care if you are in Canada or not. CEC is granted on the basis of previous experiences.

As long as your are not illegally working or overstay in Canada, you should be alright and I don't see any reason you can't apply. And you stand a very good chance since you have a LMIA job.

You employer should be able to get you a temp work permit if all documents goes well. In fact, CIC mentioned employers can apply TFW and PR at the same time for their foreigner employees so they can work in Canada while PR is in process.

Is it possible that I can just apply with an LMIA file number initially and later can update by file with CIC?

Can a employer apply for TFW without LMIA?
