Hello,

My name is Rohan Gohil and i came to Canada in 2014 on study permit, graduating doing a two year diploma from a college. Gained up to 2 years of working experience on the basis of work permit status provided to me after my graduation in 2016 till 2019 December.
I am seeking guidance as my CRS score with clb points is standing at 442, waiting on my results on this Sunday, hopefully i can increase it to 458-462 depending on the result i am expecting to score. Given that i have a lawyer that suggested two options either i can go back to my designated country India and gain another year of experience in my field which will boost me upto 508-516 CRS score and the other scenario would be based on my result if i am not able to achieve a higher score in language test, i will have to go and give it in India since i am not able to maintain any valid status here after December 19 2019. He suggested that i can increase my score and apply from India once score increases but few people have this opinion where they emphasis that inland files get processed faster than outland files, being said that can i apply for Visitor visa status from india as soon as i land there which is January in order for me to get back to Canada with a valid status and apply for PR here on forward and also how strong is the possibilities for me to get the Visiting visa after living here for almost over 5 years?
Can i get PNP in Ontario based on my stay from 2014?
I am seeking more information regarding the visiting visa and also is there any more options left for me to search for?

Please seeking guidance asap.

Thanks,

Rohan Gohil

You lawyer already gave you good advice.

If you want to stay in Canada for a bit longer, you can apply to switch your status to visitor in Canada before your work permit expires without leaving. However you won't be able to work and can stay for 6 months max at a time. You'll just be burning through your savings here.

An alternative is to apply for a study permit, go back to school and get a second degree to boost your score

No, outland applications don't necessarily take longer to process than inland applications

Hello Sir,

Appreciate the quick reply, so instead of enrolling myself into any college or university since i believe i am a little late for that plus i will have to pay international fees which is fine i can pay, can i not go to India and then apply for a Visitor visa from India once i increase my points after getting a higher score in CLB. (hopefully i increase it by Sunday & if i do i do not have to do any of these steps as i reach 462 and i have faith it will be processed within time period)
My main question is will i be eligible to get visitor visa from there aas i can apply from here once i get a visitor status? also since you mentioned it does not make any difference between inland and out-land files can i enter the country after submitting the application from INDIA as it states i am eligible to work after the application is submitted?

Thanks again

You can certainly apply for a visitor visa from India if you want

No a PR application doesn't give you right to work. you can't work on a visitor visa. And you won't be able to apply for a BOWP.
If you want to work again, you'll need to find an employer who is willing to get an approved LIMA for you and apply for a closed work permit

So lets assume that i achieve the score i wanted and i bump up my CRS score to 456 because of the increase in CLB, is that a good score to go forward and submit the file or should i go for another trial and get a higher score of 462 which is the maximum i can get from the language test but i will have to re give the test for that?
Also i am standing at 2 years and 7 months of experience and if i apply for extension of work permit my lawyer says it is not guaranteed that i will be granted an extension and because of the rejection i will have to leave the country?
Am currently working and will achieve the 3 years by March 2020 if i get the extension and that will help me increase my CRS to 522.

456 or 462 are unfortunately no longer good scores. Last few draws have been 470+. You can create a profile now and update it later on with new information. You profile would be valid for a year

There's no point applying for extension now as it's going to be rejected. It would just be a waste of time and money

So basically my only best option would be what my lawyer suggested that i boost up my points from adding work experience of 1 year in India and also increase my score as much as i can from CLB to above 510, apply as i get the result and come back on visitor status or study status next year?

No - the extension will not help to increase your score. It's guaranteed to be refused since you don't qualify for a work permit extension. Because you don't qualify for the extension, any work experience you gain after your valid work permit expires will be classified as unauthorized work and you won't be able to count it towards PR.
