I will try keep this is as succinct as possible but in short, I was charged with drug possession. These charges were formally withdrawn in court and my fingerprints were destroyed. I was given a verbal warning by the police. My national police check file states that I have no discosable court outcomes recorded against my name. I applied for an eTA to Canada about a week ago and stated "yes" to the criminal convictions/charge check-list. I then received correspondance from the CIC/IRCC stating that I were to outline my charges and outcomes of said crime. This was all before I advised my solicitor and barrister as they were on holidays and my travel dates were fast approaching - I didn't know that the charges were dropped and I have no charges on my criminal history check at the time of application.

What happens if I re-apply for another eTA and check that I haven't been charged for a criminal charge? It states that if I made a mistake that I should re-apply for new eTA but given that I answered "yes" to having a criminal charge on my old application, will the new eTA application be rejected? Will record of my previous eTA and the response I gave to the criminal charge be retained, and thus, my eTA being rejected?

I'm asking this because from online testimonies, the approval process for those who have checked "yes" to the criminal charge/conviction checklist have experienced lengthy delays in getting their eTA approved. I am travelling to Canada on the 30th of January and am afraid that if I don't get my old application approved, I will not be able to board my flight.

Should I apply for a new application? If I am approved on my new application, should I take all my court documentations, national police check file and 5-year drivers' licence history check with me in the event Canadian Border Security push me aside for questioning? What should I do? Should I upload the documents that CIC/IRRC require regarding my criminal charge and wait in hope that my old application will be approved before I am to board my flight?

Thanks in advance

I don't believe that a second eTA application will be accepted. I think you have to address the questions that have been raised with your first eTA application and provide IRCC with the paperwork they have requested. I guess you can always try and see what happens.

Yeah, since you seem to have the paperwork ready (plus a brief cover letter summarizing your docs and the outcome of the case), submit those as the response to the request.

Thanks for getting back to me about my situation but I bear good news. I applied for a second application; however the system recognised this and linked my old application with my new one. It prompted me to upload the same documents, to which I uploaded and hoped for the best.

Both applications were approved within 10 hours and I am now authroized to board the plane and continue with my plans of travelling to Canada!

That's great. Didn't know that was possible, but that's good it worked out in your favor.
