Hi there

Can anyone help me make sense of what I need to do please? My husband has been offered a job managing a farm in Nova Scotia. He has been a Naturalized Canadian citizen since 1974 but has been living back in the UK since 1999. He is going over to Nova Scotia start work mid January and our 2 year old daughter and I plan to follow around Easter time when I have wound up my business, sorted out the house etc...

I know that he can sponsor me in the Family Class for permanent residency but I know that this can take a while. I think it is better for us to apply from outside the country for speed, and because I am still here. Is that correct?

Can I move out there with him before our application is completed? Do I need to apply for a work Visa before I join him if I want to work there too while the residency application is being processed?

I think that our daughter is automatically Canadian because her father is Canadian, despite being born in the UK. So we just need to get her a Canadian passport. Is that correct?

Thank you to anyone who can help.

1.that's correct
2.Yes , you can since you are UK citizen who doesn't need a tourist visa
3.You can't get working permit because you apply outland ( Please read spousal sponsorship )
4. You must report to Canadian embassy first about your daughter

The law changed in 2009. Children born to Canadians born abroad no longer carry citizenship.

Since your husband is a citizen, he can start sponsoring you as soon as the application is complete. (Trust me, you won't have it ready by mid-January....haha.) In this case, applying Outland makes sense. You could wait until you get to Canada and do Inland if you prefer, but there aren't any real advantages for you. The only real disadvantage for Outland is if they require an interview, you would need to travel back to England. You will only have an interview if they feel your relationship isn't genuine or something else is wrong - a marriage with a child to a UK citizen is very unlikely to get an interview.

Inland application is the only way to get a work permit (unless you find a job to give you one) however, it's not advised to leave Canada for any reason while your application is in process - because if you're refused re-entry for any reason, your application is considered abandoned. Chances are, you wouldn't be denied... but that's not a risk most people are willing to take. If you decide to do this a) it will take longer to get your PR overall; b) you need to include your application for an open work permit (OWP) with your PR application; c) you must pay the fee for the OWP ($150 I believe) when you pay for the your PR fees. It takes about 6-7 months to get the OWP.

London VO takes about 9-10 months to wrap up a PR application, many times it's even faster. So Outland 10 months at worst, maybe faster. Inland 14 months.

Distance from Canada to UK is near if you compare Canada to Australia or Canada to South East Asia....

I think her daughter would indeed be a canadian citizen.

Isn't her daughter able to hold dual citizenship?

Friend of mine from Manchester married his Canadian wife they moved here had a kid. She was born Canadian but is able to hold both a British passport and a Canadian one. Is this not the same?

Second generation born abroad isn't eligible for citizenship.

Happy New Year

That sucks. I would have thought that it would work both ways. Commonwealth countries and all.

But since the father became naturalized in 1974, the child is the first generation born abroad and, as such, a citizen

That is correct the child is first generation, i heard in 2009, the brought this law, after the Lebanon Israeli war, the canadian goverment started to evacuate their citizens in Beirut and then they found like 2-3 generations of Canadians with no citizenship, requesting for evacuation.
