Hi there,

I'm doing paper work for PR application under LCP. Since I had a valid WP, I have been working as a nanny few months before I get LCP WP. For example, I have started working for my employer on May 1st 2012 and I got LCP WP on August 10th 2012. So my payroll and T4 shows I have been working for them since on May 1st 2012. I'm trying to apply for PR on option 2 (3900 hours within 22 months). Is that ok if I make timesheets for 22 months from August 10th 2012 even though my payroll and timesheet doesn't match? Like, Month 1 (August 10th 2012 to September 9th 2012) Month 2 (September 10th 2012 to October 9th 2012)... And make a letter tells about my situation.

If you dont mind me asking, How come you have started working with your employer earlier before you even have your LCP work permit? What kind of permit did you have when you started with them ( May 1st 2012)?
 
I had an international experience canada program. It depends on your nationality that you can get it or not.

Hello there! You can make a detailed timesheet to show the hours and deductions made by the employer. However you can only use the hours when you started in the program. From what you said above you got your work permit for the LCP last August. That is the start of your work hours. The hours you made when you're not in the program is invalid.

My biggest problem is my employer pays me for 174 hours a month even though in February. Only four weeks in February and if I work for 40 hours a week, only 160 hours... (I live in BC) My work schedule is very flexible but they pay me the same every time.
I thought maybe the officer doesn't care, if my employer pay me for 174 hours a months and my timesheet shows I work 40 hours a week because my payroll starts on May 1st and timeshet starts on August 10th. They would care my employer proves I work for more than 3900 hours on LCP WP.

When you apply for your PR under option 2 or 3,900 hours there is a form that your employer needs to fill out and signed. It is on this form that they will declare the date you have started with them under LCP. Also your time sheets and payroll sheets need to be signed by them too. As far as i know it wont matter if you are being paid on a straight fee, like you are working 174 hours but your time sheets shows 160 hours as long as both you and your employer agreed on it. In case the officer have any question you will receive a letter from them and they will ask for any document or explanation about the inconsistencies of your payroll from your time sheet. Anyway just submit your application and see what happens.

I think work hours on my pay roll, T4 and "statement of earnings showing hours worked and deductions" need to be matched, because I started working for my employer and paid Tax before I get LCP WP. And work hours on my timesheet and "employer declaration of hours worked" need to be matched because I need to fill out timesheet and "employer declaration of hours worked" only I worked under LCP.

You can call CIC and inquire about your case so you can have a peace of mind.

I think your are qualified to apply start august 2012 when you receive your LCP wp. Did you get it at the border? It must be issued out side canada then start counting 24 months or 3900 hrs. Since you start working with them in May 2012 with another work permit. Consider that as work experience prior to live in caregiver.


May 2012- July 2012. As nanny under work holiday visa
August 2012 - present as live in caregiver same employer.

Yes, I applied for LCP WP to Consulate in the US and I got the WP at the border. Also I understand that CIC doesn't count my nanny experience under WH WP for PR :)
