Does Conditional Permanent Resident rule apply to me?

Hi,

I applied for spouse visa on 29 March, 2012. And I landed in Canada on 10th March 2014.

I would like to know does the rule of Conditional Permanent Resident apply to me?

Look at your CoPR. If it has 51 by the Conditions, yes it applies to you. I suspect that you will not see that code.

Where Can I find the 51 by the condition on COPR? What exactly it says?

I filled my application before the amendment. so it don't fall under category. right?

Condition 51 only applies to you if you applied on or after October 25, 2012. You applied before this date and therefor you don't get conditional PR.
But if you marriage is genuine than you shouldn't worry about it anyways.

If you look at your COPR it says Personal Details and then Application Details. Under my Application Details there's Condition 51

Condition 51 only applies to you if you applied on or after October 25, 2012. You applied before this date and therefor you don't get conditional PR.
But if you marriage is genuine than you shouldn't worry about it anyways.

Thank you for your reply. Yes I am genuine. But my thing is different my wife is threatening me nowadays that I will kick your A** out of this country. She is acting so different. Even though she is acting like this I'm going to work this marriage. Like we know marriages are made in heaven. It happen only once in lifetime. I'm kinda old school. You almost 100% do NOT have conditional PR, so you cannot be "kicked out" by your wife, regardless of what SHE thinks. Even if you did, she can't kick you out. Only CIC/CBSA can do that, and in your case it's extremely unlikely that they would be interested anyway.

Thanks a lot for info. I'm going through heavy depression since few weeks. Even my body started reacting and I started falling sick thinking too much, less sleep etc.

Sorry to hear what you are going through. Nobody want to be or see you in your situation. Since you have no conditional PR, you have one less thing to worry about.

The threats your spouse have been making are empty threats. It only strengthen your cause for divorce due to verbal and mental abuse.

She will still be financially responsible for you for 3 years no matter what, divorced, separated or married. Perhaps once she realized that, she will drop the threats and be on your good side as she wouldn't want CRA coming after her when you apply for social assistance.

As stated before, that cutoff date was October 25, 2012. Your application was received before that date, so the exclusion in 72.1 (3) applies to you. The I/O is wrong, in law and in fact.

The PR conditional clause only applies to those who submitted the application on or after Oct 25, 2012.

To be 100% sure of this, you do not have conditional 51 on your COPR thus means you don't have conditional PR despite what the officials you spoke to says. They cannot dispute your COPR.

Thanks buddy. Hope this information is true. I'm very much scared. I hope you know what I am going through. I'm complete under depression. I feel like I lost my sense and mind. too much stress.
