Hello everyone,

My wife and I got married on Nov 16, 2008. Her visa is about to expire (March 4, 2009). I would like to apply for PR (inland).
My question is :
Should I apply for visa extension and PR at the same time? What if we don't get any kind of notice from the government before her visa expires? And if she stays beyond March 4 would that be considered illegal? Can she work for me? I have a company and I could put her on payroll, I guess.?
I would appreciate any kind of help. I think this is the most comprehensive forum with most knowledgeable people around.

Michael

Normally you send in the form applying to extend visit visa, application for open work permit and sponsorship in one package but if her visit visa expires on March 4, it is not about to expire, it is already expired. In that case, you should find the form for restoration of status to apply for a new visit visa for her and send it along with the application for work permit and sponsorship in one package.

She should not go home if you don't hear from them. It takes 72 days to process visit visa extension and until then she is under pending status. While she does not have a work permit, it would be illegal for her to work for you. She can expect to get a work permit after 6 or 7 months if all goes well.

Leon, thank you very much for your time. My mistake was in dates... it is April 4th and not March 4th.
From what you said I simply submit everything together and wait.

thanks again,

michael
