I want to know what is accepted as divorce proof if spouse was previously married in her home country. The first marriage was a customary nikah ceremony which was never registered in her country, however is considered valid. Then she had customary divorce five years ago with mutual understanding, and this divorce was documented by a government authorised Qadhi (the Islamic judge in Muslim personal law) in her country in front of two witnesses as per the requirements of the personal law. They maintained separate addresses since then, and updated their passports and all other documents. Based on this divorce certificate issues by Qadhi, her former husband remarried a few years ago and has a kid as well.
The divorce certificate is stamped by notary, the Sub-Divisional Megistrate and apostille by Ministry of External Affairs. In her home country, marriage and divorce done according to customary personal law of a religion are considered valid and legal, thus the couple are allowed to remarry in her home country.
I need a guidance if she is sponsored in Canada as a wife, will this document be accepted or what else she would need.
