divorce certificate question, from sweden.

Hi!

Me and my wife got married this summer and now we are bout to send in our application for sponsorship.
I only have 1 issue, we dont get divorce certificates in Sweden (from previous marriage). I have the same paper the proved me being divorced we used to get our marriage license. A type of birth certificate (proof of person roughly translated) that we can get from our tax agency (we use them for everything) and it says I'm divorced, but no dates and who I divorced.
We think this should do, because we could get married with it, so B.C accepted it.

It is hard to explain, but do you think this will cause a problem?

hey! and welcome to the forum.

Another member had the same issue. She could only get the personbevis from Sweden ( I believe that's the one you're referring to when calling it "proof of person"), and apparently CIC said it was not enough, so she was trying to get an actual paper from the court that pronounced her divorce to add to her file.
I think that as long as you have the new marriage certificate, it should be good I think...

What I would do would be to send your application with the personbevis + new marriage certificate and an explanation that it's what you get from Sweden ( you're probably not the only one). While your application is being processed, or stand in queue (depending if you're applying inland or outland), you could try and get a paper from the court that pronounced your divorce in Sweden... so in case you are asked for it, you have already started the process of obtaining it.... but your application is already started as well.

I think it would be one way to ensure that you don't wait too much - and maybe CIC will accept it, I don't think there is an "absolute rule" about that....

Im going to call the court that finalized our divorce and see it I can get a paper from the or maybe a paper that says that we don't use those kinds of certificates in Sweden.

I was just wondering if you applied 'outland', does your application go to a VO in Sweden? The reason I ask is, when I went to CEM in Manila, it seems the employees there . . . were Filipino. So it stands to reason that if there's a VO in Sweden, it's employees (or some of them at least) would be Swedish, albeit perhaps Canadian-Swedish. BUT, they would understand that such a document does not exist. See where I'm going with that?

No, applying inland, so they would maybe not understand...
I think the big culprit is the Swedish (awesome) system of having everything centralized and following the personal identification number we get when we are born, but it's a pain in the a** when trying to get it to work with other countries ways of doing things :S

Ok, but you realize you REALLY are allowed to apply 'outland' even though you are in Canada right? Really! It's openly accepted, and quite often done.

Im here on student visa and (hopefully, if not for more cancellations of classes) I will graduate in late march and start a post-grad work visa, before the time for the application to be done at step 1. This is best possible scenario. If it takes longer it would be nice to know that I can get the work permit after about 6 months (inland) rather then have to wait all 9 months + 50 days (london).

But maybe I'm not getting the benefits of applying outland.

I'm sure that a personbevis would be acceptable - if it's ok to use in lieu of a birth certificate I'm sure you'll be fine using it to prove that you're properly divorced.

And I'd like to chime in and say that applying outland most likely is going to be much quicker. You can be in Canada while applying as long as you're legally in the country.

to answer your question - there is no VO in Sweden ( or in Scandinavia for that matter) so all residents of Scandinavia go through London... so they don't know much about the swedish system... but in general it's rather uncomplicated applications and very few people get called for an interview, so not much travelling involved...

you can't get a work permit after step 1 when applying outland right?

indeed - you can't get a work permit... but if you apply inland, the main problem is that you are not allowed to leave Canada during the time of the process ( so no holidays home and no going home for family emergencies etc ) - which can be problematic...
Outland can go much faster, especially if you have an uncomplicated case. First stage is currently 45+ days, but quite a few people get done faster, and if your sponsor lives in Canada, then it's even easier to get approved...
London is 9 months to complete 80% of the applications, but if you look at the spreadsheet ( in my signature) you can see that quite a few people get done in 3 to 4 months ( my application was total 7 months, with a 3 months first stage). So you could be done potentially and have your PR by the time you would be done for inland first stage only...
For people going through London VO, and who are visa-exempt, there are very few reasons to apply inland, as it's a rather "fast" VO. Also, if your work permit or study permit expires before you have your PR, you could switch to a visitor visa (by applying online, no need to go out of the country), to bridge the gap until you have your PR...

It's still a possibility, no worries! it's hidden in the "inland guideline" if you really want to find it. it hasn't changed, and if your VO is going to be London, outland is probably a much faster option.
