Hi,

I have a multiple entry tourist visa. My brother and mother are Canadian citizens already. My brother wants to hire a caregiver for our elderly mother. He received an LMO. He wanted to hire me instead and i agreed to take care of our mother. I am a 60 year old housewife. My children are all grown.

Somebody advised us (badly) that i can get a working visa if i do the Flagpole and bring the LMO with me. When i got to the flagpole, the officer very nicely advised me that what i did was not the right procedure. And so I was told that she would gladly see me back in Canada but i have to apply from outside of Canada. The officer gave me the LMO and said that i should tell the Canadian embassy from the country i would be applying from about what happened. When i left Canada, i had an immigration escort with me. They said that this is all procedure and they wish to see me back in Canada soon.

I am about to apply from the Philppines now to get my work visa. I want to explain to the embassy abt what happened but they do not entertain queries and applicants do not get a chance to speak with the embassy staff to get advise.

I plan to write the embassy explaining what happened to me. I already have an LMO with me.

I want to know:

1. Will it hurt my chances to get a visa since i unwittingly didnt follow the correct procedure?

2. The Flagpole officer was very nice and helpful, but will this incident be put on my records?

3. Will it hurt my chances that i had an immigration officer escort me at the airport (even if he was friendly)

I hope someone can give me advise.

Thank you very much.

Hi Margzy,

Did you have the 6-month training or at least one year full time caregiver required for Live-In Caregivers?

And this has to be in the last three years.

Thank you so much for your reply.

I am a registered nurse. I am 60 years old.

I worked as a nurse in a clinic for a couple of years. and also i had a sideline working at night as a caregiver for a year.

I hope you can advise me.

If you had asked before you flagpoled, you might have had te processing done in Canada, but anyway water under the bridge. You can try and apply from the Philippines, considering you were a nurse. Apply for the WP and attach the LMO (hoping the LMO is in your name). But processing for live in care givers from the Phils is 12-18 months.

Thank you.

So is there a need for me to still write a letter explaining what happened at the flagpole to the embassy?

Also, can i return to Canada as a tourist, since i have multiple visa, to take care of my mother even if I already applied for a WP?

The LMO is in my name. Is the processing time still 12-18mos even if i already have the LMO?

Thank you all so very much!!!!

Yes, processing time is 12-18 months. You may have been flagged in the system, so coming back so soon after the incident might not be a good idea. You can't come and reason out you're coming to take care of your mother but you can reason out that you being a daughter would be the best choice to give the love and care your mother needs.

Okay, i will do that.

But i just want to clarify, you are saying that it is okay for me to write a letter explaining what happened even if there's a chance that my case might not have been flagged in the system? I just want to make sure that i don't mess it up again.

You have no way of finding out if your name has been flagged in the system or not. For this reason, you should definitely include a letter explaining what happened.
