The lawyer (located in Canada) who handled his case received the application back on 29 jan, with the letter from CIO dated 15 jan 2015.

So it seems that by now the CIO already checked for completeness all the applications.
And it seems that an application returned from CIO takes around 14 days to reach the destination in Canada. So if the destination is somewhere else in the world, obviously would take much longer for the application to be returned.

PS. I don't know under what NOC he applied.

Overall, generally, most applicants are not likely to encounter any more than minimal delays due to background clearances. Some will, most will not.


There are three formal clearances (background checks) required for grant citizenship applicants.

These are: GCMS; RCMP; and CSIS

They are essentially, respectively:

GCMS: immigration (confirmation of status and admissibility)

RCMP: criminal background, which can be more robust than just the name-record criminal history check, which probably means it can involve queries beyond arrest and disposition records, such as into whether any law enforcement body is conducting an investigation or the individual is a suspect or has known connections to those known to be involved in criminality (the name-record criminal history check is done periodically throughout the process, and is similar to one often conducted during any secondary examination at a POE, and it is mostly a query run against an arrest and dispositions database based on individual's name and date-of-birth)

CSIS: security background (while obviously the scope of this is not public information, it is readily recognized that it at least involves queries into intelligence sourced databases, and other government security databases, which might reveal activity or ties related to organized crime, terrorist organizations, suspect military history)

These clearances are all requested by CPC-Sydney upon the application being placed "in process." The RCMP and CSIS requests are done by referral to, obviously, the RCMP and CSIS. (Thus, the RCMP and CSIS clearances are not done by CIC, but by referral to the respective government body.)

Previously, for sure, and probably still the case, the fact that clearances are outstanding does not preclude the application moving to the next step in the process until the test/interview step. It appears clear, though, that any outstanding clearance will delay scheduling the test/interview; note that other participants have recently reported receiving letters specifically indicating their scheduling for the test/interview "may be delayed if security, criminal and immigration background checks are not complete."

In this regard, however, there may be a difference between whether the original clearance, in response to the referral from CPC-Sydney, is complete, in contrast to an expired clearance which is in need of an update.

For sure, clearances will be need to be current, and thus those expired need to be updated, before the oath will be scheduled.

I feel sad for the guy whose application was returned, maybe he should get his money back from the lawyer who did not guide him through... :mad: :mad: :mad:

No it doesn't mean that. Some of 9th December applicants get their CC charged today as well. Therefore be optimistic and specially if your NOC was a cold NOC, you will surely get your CC charged today or tomorrow. BTW CIO is also working on Saturdays these days. They are only closed on Sundays.

Very sorry to hear about your application returned to you for something as silly as a photocopy instead of the original of WES.
When it comes to immigration believe it or not, consultants/lawyers are nothing but glorified paper-pushers, anyone who has the minimal idea about the FSW1 immigration program should know that you should submit the original WES ECA report and the original IELTS score report.


Having said all of the above, you need to review your agreement with the lawyer/consultant and all your correspondence with them and see if they were the ones who advised for submitting the copy of WES, or did not advise against submitting the copy of the WES report.

But first of all, you should ask for the original letter that came along with the package when it was returned from CIC and make sure that the reason for rejection was actually what the consultant told you (Lack of WES ECA ORIGINAL report)

Most of the time, the lawyer/consultant agreement protects them against anything and everything, but you ca take it a step further by filing a complaint against them in whatever professional body or association they are members of and escalate things from there, at a minimum, you should ask for a full refund of all your fees and expenses.

In the meantime, you should enroll in the Express Entry program as soon as possible,

Good luck with whatever course of action you decide to pursue.

A consultant lawyer doesn't have any leverage in your application or approval with CIC, as the occupation name indicates he will only guide you and help you in the process of gathering the requirements for the applications. It's mandatory to have an consultant, the answer is NO. Can an consultant help you, the answer is YES. It depends on your case, the time you have to gather the information about how the process is and how fast you wanna go with your application.

In the case you decide to hire a consultant is highly recommended to go with the one who has many references, it's better to spend a little more and be guided by an experience lawyer.
