Hi. I am currently living the USA with my two boys 2 and 4 months old and my "boyfriend". He is emotionally and verbally abusive and I need to get out. My whole family lives in Canada. I need to get out and go home.

I am not sure where to start. I know my boys are canadian citizens but I need to apply for proof but they do both have us passports.

Should I file for custody here in Alaska or is it best to go home to canada and file there. Can i cross the border with no letter. I do not want to do any international kidnapping. Currently there is no custody order.

However I can tell you that you absolutely cannot cross the border without a letter. You absolutely need the father's consent to remove the children from the US and bring them to Canada. You need to sort out your custody issues in Alaska.

You need to advise a real lawyer. Not immigration consultant. Did you ever press the charges against your boyfriend? If not, the threat doesn't exist. You can't just take away children from father. Cases like this need to be well documented.
