HEllo All,

I am currently working in Canada and waiting for 1 year to complete to apply for PR under Canadian experience category, which is not very far away :)

Now assuming that my PR is in pending state, can i switch job without hassles or need LMO clearence before i switch job?

Thanks!

There's a few requirements you have to meet.
- You apply for PR
- You get AOR
- You can apply for BOWP, after you get AOR when your current WP is expiring in the next 4 months.

Or,
- You apply for PR
- already have an open work permit, then you can switch without a LMO

In case you hold a closed WP right now, you won't be able to switch right away.

Thanks a lot for your response!

I have only closed work permit at this time,

so option 1 of applying PR, getting AOR and then applying BOWP should allow me to switch employer without LMO.

Note that BOWP is only issued when your work permit expires in the next four months (there are exceptions but don't count on it).

Exactly. It's an open work permit and therefore not bound to an employer.

Thanks! My Work Permit is expiring by end of Jan 2014, Planning for IELTS by October and apply for PR in December. Hope AOR is fast and i can apply for BOWP before End of Jan.

I have a question : What if my employer process extension of the closed work permit? Seems like i cant appy for BOWP in that case and i have to wait for PR to be approved before i switch job?

Thanks

AOR takes about 55-60 days right now.

Yes, one of the requirements for BOWP is that your current WP is expiring in the next four months.
So if you re-new your current WP you might have to wait until you get eligible for BOWP.
However, there are cases where individuals got the BOWP approved with a WP valid for more than 4 months.
But there's no guarantee the VO assessing your application will approve it.

Thanks

Check comments in red above, hope this helps.

Hi, I have a similar question

I have an inter-company transfer work permit which has been renewed for three years recently (valid until 2016). I filed my PR request in August and I am waiting for the AOR.
On the other hand I have a new job offer in Canada which should start on January 1st 2014. Is there any way to

a) transfer the current work permit to a new employer
b) get an open work permit
c) any other option?

An inter-company transfer work permit is issued quite quickly (a month or less) however you need to be employed with the company for at least 1 year. As far as I know a work permit for a new employee is not issued that easily/quickly.

Any thoughts on that?

Very much appreciated

Thanks
nsk

Yes, have your future employer apply for a LMO

Sorry I have couple of more question related to my original post,

1. Since I will be gaining 1 year experience in Canada in Dec 13, I am thinking that it will be too late to wait until dec to apply under CEC and get BOWP...so can I apply under Fed Skilled worker category next month itself or will that not be helpful in terms of PR in long term?

Total yrs of exp: 14
Profession: Proj Manager in IT
US Experience is 7 years
Canada Exp is 9 months

2. Do i need to get Police verification or FBI verification for all of my family members or only for me as primary applicant? Also how many years of police verification required as i was in US for 7 years and before that all in India, so should i get police check done from both countries?

Thanks
