For those Inland applicants that are unaware of what it takes to get AIP...
According to the flowchart found in publication ip08 (page 51) Stage 1 approval for Inland applications is in fact a bit more than just `approval of sponsor' (unlike Outland).
The following must be met before AIP is issued:
Step 1- Sponsorship Evaluation
Question 1:
Is PR/Sponsorship application complete?
Question 2:
Does the sponsor satisfy R130 requirements?
␣ Canadian citizen or PR
␣ At least 18 years of age
␣ Residing in Canada
Question 3:
Does the sponsor satisfy R133 requirements?
␣ not under removal order
␣ not detained in penitentiary, jail or reformatory
␣ not convicted of an offence of a sexual nature against any person or of an offence that results in bodily harm against a family member
␣ not in default of previous sponsorship, support payments or immigration debt
␣ not an undischarged bankrupt
␣ not on social assistance (aside from disability)
IF YES, THEN...
Question 4:
Is Foreign National (applicant) a member of the [family] class (R124)?
␣ spouse or common- law partner of a sponsor
␣ cohabitating with sponsor in Canada
␣ (temporary resident status)*
␣ sponsorship submitted (and approved)
␣ Is FN excluded from the class due to R125 provisions– excluded relationships?
* May be waived using public policy, However, status still needed to work or study in Canada
(see more in ip08-Appendix H `Lack of Status').
IF YES, THEN...AIP is issued.
Stage 2 approval is where applicant does NOT meet the following:
␣ Security?
␣ Human or international rights violation?
␣ Financial reasons?*
␣ Criminality/Serious criminality?
␣ Security?
␣ Health grounds?*
␣ Misrepresentation?
␣ Inadmissible family member?
*(Taking into account relevant exceptions made for the in-Canada class excessive demand provisions)
After that...hopefully positive DM!
