Criminal charges - leaving Canada

Can anyone tell me as a PR are you allowed to leave Canada while there are outstanding criminal charges? CBSA won't give me a straight answer. If you leave Canada, upon your return would you be allowed re-entry? The charges would cause inadmissability but there is no conviction as of yet.

1. Yes you can leave, as long as your bail conditions (if any ) allow it.
2. Until you are convicted you are not inadmissible.

just wanted to ask a question based on these conversations. If someone has a bad police record (not charged not convicted tc), would that be checked by the cbsa (during entry into the country as a wp or pr) and it could lead to inadmissability??

What does "a bad police record" mean?

It would mean your ATIP (access to privacy act document). It might show whatever random complaints you have received maybe from an enemy or a hating party. Would this be checked by the cbsa? (PCC is clean and no charge, nthing).

I don't think that type of info is recorded in a government data base in Canada.

If it’s been reported to the police, there will be a record of it. Whether it affects your entry, that would depend on if charges were laid or if there are convictions. If you are worried about not disclosing the information, I would caution to err on the safe side. Telling them about reports that don’t affect your entry, but withholding it could result in misrepresentation.
