Country of Residence question

Hi,

I have lived in Austalia legally (with a student visa) for more than 1 year.
Last year I went to my home country for about five months. Now
I am back again to continue my studies and it has been two months since
my last entry into Australia. I am planning to apply for Canadian
Immigration in the Federal Skilled Worker Category.

Now my question is, Can I apply at the Canadian Embassy in Australia?
Or I have to apply in the embassy for my country of Nationality?

If you were admitted this last time to Australia for 1 year, then you can apply to Sydney.

I am a little confused.
Can you please clarify "admitted this last time to Australia for 1 year"?

My case is as follows:
1. From June-2005 till September-2006 = Lived in Australia legally.
2. From October-2006 till Februrary-2007 = Lived Outside Australia
3. From February-2007 - Present = Back in Australia & will stay here for more than one year.

Does living in Australia legally for more than one year in the past allow me to apply in Sydney,
or the one year legal stay has to be in the immidiately previous twelve months?

Please note the operative word is ADMITTED. On your last entry to Australia, if they gave you a stamp or document that allows you to remain in Australia for 1 year, then you can apply to Sydney. Example, if arrived on 01/01/07 and were admitted to 01/01/08 you could apply to Sydney, but if you were admitted 01/01/07 and the stamp was to 01/07/07 you cannot apply to Sydney.

Thank you so much for your response!!
They have not given me a stamp/seal in the passport at the time of admission/entry indicating the how long I can stay.
But I have entered with a student visa (issued at the Australian Consulate in my home country) which is valid till December 2008.
So I guess I have the document to remain in Australia for more than a year, and can apply from Sydney.
Correct? Please let me know if I have missed anything.

1. Yes you can apply at Sydney since the admission is over a year,.

Hi

My case is similar to your case, instead I was living in Australia on Student Visa for 2.5 years. I applied in May 2005 and received AOR with in a month. Nowthat waiting for further progress from Sydney office.

I am sure that you could launch the application in Sydney office. All the best.
