Hi all,

I am in convention refugee. I have a work permit.
I'm in relationship with a girl from France. She can't stay and work in Canada because she doesn't have a work permit.
May she pretend to be my common law partner to get a work permit so she could stay in Canada?

Thanks

You can't pretend to be common law. To be considered as common law you have to provide actual proof that you have physically lived together for a year. CIC isn't going to take your word for it. If you lie, expect this to cause problems for your refugee application.

We are in a relationships for more than a year, lived together about 4 months.

But anyway, thank you for the replies. It really helped.
At least now I know the definition of my relationships - it is FRAUD (Caps lock is necessary).
Thanks again.

Unfortunately it doesn't matter how long you have been dating. All that matters is how long you have lived together. You are not common law and cannot include her in your application.

The way you worded it: "pretend to be common law so she can get a work visa" made it sound fraudulent. Going out of your way to deceive CIC that your relationship is something it isn't (common law) would be considered fraud.

You're being too kind in your reply. It wasn't the way the OP worded it. It's quite clear the OP was asking about lying and claiming common law to obtain an immigration benefit which he knew he didn't qualify for.

Let's all be honest, he was asking for advice on committing immigration fraud. Might as well call a spade a spade.

So true. It's offensive to everyone else who has applied honestly through spousal sponsorship.

No, I wasn't asking an advice how to lie. I was asking about the situation in general.
English is not my first language, so I thought that the word "to pretend" is appropriate to describe the situation.
Just wanted to ask how does the system work.
But looks like nobody wants to figure out what exactly I was asking, it is easier to imagine missing part than to ask about the details.
Yes, I didn't describe the situation in all details, but you shouldn't blame me in fraud without even asking more details.
Thanks anyway.
