consequences of losing PR status?

Hi folks,

I'm new here. I wish there was a FAQ on this forum. It's tough trying to peruse the forums finding the answer to what is possibly the same old questions. Anyways, I've tried digging around the net for an answer to my question, and it still alludes me. If I apply and get PR in Canada, but I do not fulfill the residency obligations and eventually lost my PR status, what are the long term consequences? Will I not be able to apply for PR or citizenship in the future?

The reason I ask is because my Canadian wife and I are living in the States. Her short term goal is to return to Canada. Currently, the job market in BC is quite tough in health care. She keeps looking, and keeps getting denied for interviews and what not. It's pretty frustrating. Ultimately, though, we will be there. However, I cannot know if she and I will be able to get jobs there in the next 5 years. If we don't, we will continue to live here in the States. So, hence my question. I would like to apply and get PR so that when we do move, I can apply for jobs and begin working immediately.

If you are in fact accompanying your Canadian spouse, your PR status is maintained. You don't have to worry about losing your PR status. If your PR card would expire, then let it expire. Your PR card expiry date has nothing to do with your PR status.

If I read your question correctly you are not currently a PR of Canada and are wondering about possibilities in the event of obtaining and possibily loss of PR status if you were to obtain it.

If correct: if you lose your residency due to failing to maintain residency you could apply again as things stands today for PR. You could not apply for citizenship unless you were a PR in status at the time you applied for citizenship and resided in Canada the required time prior to submitting a citizenship application.

Legislation is currently in a state of flux so any number of changes are possible once various changes are enacted or not as the case may be.

Much thanks, guys. Yep, I'm not currently a PR of Canada. I'm just wondering if it would be a bad idea for me to begin the process now without knowing when we'll be moving back to Canada.

I have also contacted the local Canadian immigration offices via email. Still haven't heard from them. I guess there is no harm in filing for PR. Although, I'll ask around a bit more (no offense, guys, just trying to do more DD) before applying.

Hi Pippin,

Sorry for the belated response. My wife is a respiratory therapist by trade; however, she is finishing up a masters in health care administration and is currently an assistant director. Her goal is to become a hospital administrator, but she is also looking at other fields such as risk management, quality control, and policy and accreditation. She is originally from Prince George, but she would love to settle in Kelowna, Kamloops, or around Vancouver--even Victoria would be great.

Anyways, it's no surprise that the job market is tough in her industry. It has been quite competitive in Los Angeles as well.
